This case challenged the Trump Administration's cancellation of numerous previously awarded federal grants to the plaintiffs under a rule promulgated by the Office of Management and Budget (OMB) in 2024 that allows the termination of grants "if an award no longer effectuates the program goals or agency priorities.” In February 2025, President Trump ordered agencies "to review all existing covered contracts and grants and, where appropriate and consistent with applicable law, terminate or modify…

This case challenged the Trump Administration's cancellation of numerous previously awarded federal grants to the plaintiffs under a rule promulgated by the Office of Management and Budget (OMB) in 2024 that allows the termination of grants "if an award no longer effectuates the program goals or agency priorities.” In February 2025, President Trump ordered agencies "to review all existing covered contracts and grants and, where appropriate and consistent with applicable law, terminate or modify . . . such covered contracts and grants to reduce overall Federal spending or reallocate spending to promote efficiency and advance the policies of my Administration." In keeping with that directive, agencies terminated thousands of grants to the plaintiffs, arguing that the awards no longer effectuate the policies of the administration (and thus the agency).

On June 24, 2025, the plaintiffs, consisting of twenty-one states and the District of Columbia, brought suit in the District Court of the District of Massachusetts against the Office of Management and Budget, the Department of Agriculture, the Department of Commerce, the Department of Defense, the Department of Homeland Security, the Department of Justice, the Department of Labor, the Department of State, the Environmental Protection Agency, the Federal Emergency Management Agency, the National Endowment for the Humanities, and the National Science Foundation. Represented by their attorneys general, the plaintiff states argued that the defendants could not revoke grants under OMB's regulation "if the award terms and conditions themselves do not clearly and unambiguously specify that the grant can be terminated when it no longer effectuates the program goals or agency priorities." The states also claimed that the defendants could not terminate grants "where Congress has directed funds to be spent on particular grant programs or where Congress has appropriated money for an identified objective and the agency substitutes its own 'agency priorities' for the objective identified by Congress." Finally, the states argued that grants could only be terminated under the regulation "if the grant no longer effectuates 'agency priorities' that were identified at the time of the federal award."

The plaintiffs asked the court to issue a declaratory judgment holding that the agencies could only terminate grants if they met the limitations identified by the plaintiffs. The plaintiffs also asked the court to hold that the defendants' actions were contrary to law and arbitrary and capricious under the Administrative Procedure Act (APA). 

The case was assigned to District Judge Indira Talwani.
