This case challenges the federal government’s plan to destroy Chí’chil Biłda-goteel, or Oak Flat, a long-recognized Native American sacred site. Oak Flat is a centuries-old place of worship for the Western Apache tribe; it is a “direct corridor to the Creator and the locus of sacred rituals that are uniquely tied to that place and cannot be replicated elsewhere.”

Since the mid-1900s, the federal government has recognized the significance of Oak Flat and has preserved it from mining activities to protect the Apache rituals that occurred there. That changed when a large copper deposit was discovered underneath Oak Flat, and the government, in 2014, transferred the site to Resolution Copper, a foreign-owned mining company, who will create a mine and destroy the site.

On July 24, 2025, several Apache women and girls who worshipped at Oak Flat filed this lawsuit in the U.S. District Court for the District of Columbia against the United States of America; the U.S. Department of Agriculture (USDA) and its Secretary; and the U.S. Forest Service and its Chief. They challenged the Government's plan to destroy Oak Flat, in violation of federal statutes and the Constitution. They alleged that Defendants' actions violated the Religious Freedom Restoration Act (RFRA), the First Amendment to the U.S. Constitution, the National Environmental Policy Act (NEPA), the National Historic Preservation Act (NHPA), and the Administrative Procedure Act (APA). 

The day the case was filed, Resolution Copper filed a motion to intervene in the litigation, which was granted by the court on August 1 because they have “a claim or defense that shares with the main action a common question of law or fact.”

The case was originally assigned to District Judge Timothy James Kelly in the District Court for the District of Columbia, but was transferred to District Judge Dominic William Lanza in the District of Arizona on August 1, 2025. 2025 WL 2193001. The case was transferred upon a Defendants’ and Intervenor-Defendant’s motion to transfer venue because three other cases also challenging the transfer of Oak Flat to Resolution Copper were brought in the District of Arizona in January 2021 and were being litigated there. Judge Kelly also noted that Plaintiffs’ decision to file in the District Court for the District of Columbia “raises the specter of forum-shopping” because the Ninth Circuit’s decision in Apache Stronghold “would appear to doom many of their First Amendment and RFRA claims.”

On July 25, 2025, Plaintiffs filed a motion for preliminary injunction seeking to enjoin the federal government from carrying out its plan to transfer Oak Flat to Resolution Copper for the mining project that would destroy the sacred site on August 19, 2025. In the alternative, if the motion for preliminary injunction were to be denied, Plaintiffs requested an injunction pending appeal on August 15 via an emergency motion.

The court denied both motions on August 17. 2025 WL 2380475. The court found the RFRA and Free Exercise claims were foreclosed by binding Ninth Circuit precedent established in Apache Stronghold, and the NEPA claims, including the page-limit challenge, were unlikely to succeed because Plaintiffs could not demonstrate that they were injured or that NEPA’s goals were materially impeded. Furthermore, the alternative request for an injunction pending appeal was denied for the same reasons, as the court requires a stronger showing on the merits to grant such relief.

The same day, Plaintiffs filed an interlocutory appeal in the Ninth Circuit. Briefing is ongoing, and oral argument is scheduled for January 7, 2026. Several amici briefs have been filed for both sides. 

In a related case—Arizona Mining Reform Coalition v. U.S. Forest Service—the Ninth Circuit granted a temporary administrative injunction on August 18 to preserve the status quo and enjoined from conveying Oak Flat for the fiscal year, until the court has time to reach the merits of the dispute.
