This is a case challenging whether a recently passed provision of the Colorado Anti-Discrimination Act (CADA) violates a private company's First and Fourteenth Amendment rights. On May 27, 2025, XX-XY Athletics filed suit in the U.S. District Court of the District of Colorado against the Director of the Colorado Civil Rights, members of the the Colorado Civil Rights Commission, and the Colorado Attorney General, all in their official capacities. Represented by an attorney from the Alliance Defending Freedom and additional private counsel, plaintiffs filed this suit seeking declaratory and injunctive relief against the Colorado Civil Rights Commission to prevent the Commission from enforcing the CADA provision. This suit specifically challenged HB25-1312 which amended the Colorado Anti-Discrimination Act (CADA) to define “gender expression” as including “chosen name” and “how an individual chooses to be addressed.” XX-XY claimed that enforcement of these provisions in CADA would violate constitutionally protected speech, expression, and the right to equal protection. 

This case was assigned to U.S. District Judge Regina M. Rodriguez. 

On June 17, 2025, plaintiffs moved for a Preliminary Injunction to prevent the Commission from enforcement of the new CADA provision. The Motion had not been ruled on as of September 13, 2025. On August 7, 2025, defendants moved for Dismissal. The Motion had not been ruled on as of September 13, 2025. This lawsuit remains ongoing.
