On July 29, 2025, several states (California, Colorado, Connecticut, Delaware, District of Columbia, Hawaiʻi, Illinois, Maine, Maryland, the Commonwealth of Massachusetts, Michigan, Minnesota, Nevada, New Jersey, New Mexico, New York, North Carolina Oregon, Rhode Island, Vermont, Washington, Wisconsin, and Pennsylvania) filed this lawsuit in the U.S. District Court for the District of Massachusetts against the U.S. Department of Health and Human Services (HHS) and its Secretary and the Centers for Medicare and Medicaid Services (CMS) and its Administrator. Plaintiffs challenged Section 71113 of "An Act to Provide for Reconciliation under Title II of H. Con. Res. 14" (the "Defund Provision"), which prohibited the use of federal funds for any health care services obtained at Planned Parenthood health centers.

Plaintiffs alleged that the Defund Provision violated the Spending Clause of the U.S. Constitution. According to the complaint, the Defund Provision denied access to health centers that provided essential, lifesaving care, such as cancer screening and prevention, testing and treatment for sexually transmitted infections (STI), and family planning services, as retribution for the health centers’ political advocacy.  Plaintiffs requested the Court to declare that the Defund Provision was unconstitutional, enter a preliminary and permanent injunction against Defendants and any other agency or employee acting on behalf of Defendants prohibiting enforcement of the Defund Provision, and award the States’ costs, expenses, and reasonable attorneys’ fees.

Judge Indira Talwani was assigned to the case.

On September 24, 2025 the state of California filed a motion seeking a preliminary injunction enjoining the government from implementing or enforcing Section 71113 of the “One Big Beautiful Bill.” The plaintiffs and the defendants then moved jointly to compel the court to set the briefing schedule regarding Plaintiffs' preliminary injunction motion and to stay the government's obligation to file a response to Plaintiffs' complaint pending resolution of the preliminary injunction. In this motion, the parties agreed on dates for the government to respond to Plaintiffs' preliminary injunction motion and for Plaintiffs to reply to the government's response. Judge Talwani granted the joint motion.

On October 1, 2025, the government filed a motion to stay the proceedings in light of the appropriations act funding the Department of Justice lapsing due to the government shutdown. After Plaintiffs filed their opposition to the government's motion, the court ruled that the “lapse in appropriations [did] not justify a stay of these proceedings” due to Plaintiffs’ interests in the case outweighing Defendants’ interest in a stay.

Defendants filed a response to Plaintiff’s motion for a preliminary injunction to which Plaintiffs submitted a reply ahead of the court ruling on the matter. Arguments regarding the preliminary injunction were heard on November 24, 2025.

On December 2, 2025, the court issued an order granting the Plaintiffs' motion for a preliminary injunction and enjoining the Defendants from enforcing or otherwise applying Section 71113 and requiring them to take all steps necessary to ensure that Medicaid funding continued to be disbursed in the customary manner and timeframes to the Plaintiff States. 2025 WL 3459579. The court held, first, that the Plaintiff states had standing to bring this action, reasoning that they had put forth specific costs that would not be incurred but for Section 71113's requirements and had therefore identified a particular fiscal injury sufficient to assert standing. In addition, the court rejected the Defendants' characterization of the Plaintiffs' claims as parens patriae (or, protector) on behalf of citizens and other health care providers, explaining that because the Plaintiff states had already developed and received approval for state-specific Medicaid plans involving those providers, they faced real administrative and financial burdens as a result of the challenged statute. Next, the court concluded that the Plaintiffs had demonstrated a strong likelihood of success on the merits of their claim that Section 71113 failed to provide states with clear notice, in violation of the Spending Clause. It reasoned that Section 71113 was impermissibly ambiguous as to some prohibited entities, and as to others, that the Plaintiff states could not have anticipated the statute's broad prohibition, without prior notice, on the use of health care providers comprising important parts of previously approved Medicaid plans.  Because the Plaintiffs faced irreparable harm in the form of increased administrative and health care costs, and in light of the balance of equities and public interest, the court therefore granted preliminary injunctive relief.  Finally, finding that Defendants were unlikely to prevail on appeal, the court denied their request for a stay of the preliminary injunction pending appeal.

The U.S. appealed and sought an administrative stay and a longer term stay, while that appeal was pending.  On December 8, 2025, the First Circuit granted the administrative stay without expressing any view on the merits, stating that it intended to rule promptly.

Defendants shall provide a copy of this Order to all personnel within the Department of Health and Human Services and all state agencies involved with the disbursement of Medicaid funding.4.
