This case challenged actions taken by the Trump Administration targeting transgender individuals and gender-affirming healthcare for those under the age of 19. A coalition of states alleged that Executive Order 14187 (the "Denial of Care" Order) and subsequent directives issued by the U.S. Department of Justice (DOJ) -- including the April 22 Bondi Directive and the June 11 Shumate Directive -- misrepresented the prevailing medical consensus, interfered with state authority to regulate the practice of medicine, and were intended to intimidate healthcare providers through unfounded threats of civil and criminal liability under statutes such as the False Claims Act, the Female Genital Mutilation Act, and the Food, Drug, and Cosmetic Act. The complaint alleged that these federal actions caused hospitals to reduce or discontinue gender-affirming care for adolescents, resulting in significant harm to patients and undermining state laws that protect access to such care. 

On August 1, 2025, several states and the Governor of Pennsylvania filed this lawsuit in the U.S. District Court for the District of Massachusetts against the President of the United States, the U.S. Attorney General, and the U.S. Department of Justice. Plaintiffs alleged that Defendants' actions violated the Administrative Procedure Act (APA) and the Tenth Amendment to the U.S. Constitution. They sought declaratory relief holding that Section 8 of Executive Order 14187 is unlawful and that the provision of gender-affirming healthcare does not violate the Female Genital Mutilation Act, the Food, Drug, and Cosmetic Act, or the False Claims Act. Plaintiffs further requested that the Court set aside the April 22 Bondi Directive and the June 11 Shumate Directive, and enjoin Defendants from enforcing them in any manner inconsistent with the requested declaratory relief. The case was assigned to U.S. District Judge Angel Kelley.

On November 21, 2025, Defendants filed a Motion to Dismiss, arguing that Plaintiffs lacked standing. Defendants argued that Plaintiffs lack standing to challenge agency enforcement priorities, and that Plaintiffs failed to allege a concrete or imminent dispute. Defendants also argued that Plaintiffs did not allege final agency action and thus have no claim under the Administrative Procedures Act.

On December 22, 2025, Plaintiffs filed an Opposition to the Motion to Dismiss, arguing that the DOJ's enforcement of the EO directly injures plaintiff states, and that the DOJ's actions are final agency actions, such that they have standing to pursue all claims.
