This case challenges the State Department’s use of § 221(g) “administrative processing” and DS-5535 enhanced-vetting procedures to indefinitely delay adjudication of immigrant-visa applications for Iranian nationals. Plaintiffs allege that these practices amount to an unlawful effort to restrict immigration by keeping applications in perpetual review.

On May 31, 2024, ninety seven Iranian nationals—including principal employment-based immigrant-visa applicants, their spouses, and minor children—filed this suit against Secretary of State Antony Blinken and the Acting Director of the Office of Screening, Analysis, and Coordination. Plaintiffs asserted six causes of action under the Administrative Procedure Act (APA), 5 U.S.C. §§ 706(1), 706(2)(A), 706(2)(D), 555(b), and the Mandamus Act, 28 U.S.C. § 1361.

In Counts I and II, plaintiffs sought a declaration under the APA that two State Department policies are unlawful: (1) the “DS-5535 scheme,” which requires applicants to submit DS-5535 security-questionnaire responses after their consular interviews rather than with their visa applications, and (2) the “§ 221(g) non-final notice scheme,” under which consular officers refuse visas by issuing non-final decisions pursuant to INA § 221(g). Plaintiffs alleged that both policies cause unreasonable delays in adjudication. In Counts III through V, they asserted additional APA claims under §§ 706(1), 706(2), and 555(b), seeking declaratory relief compelling the State Department to complete adjudication within 30 days. Count VI, brought under the Mandamus Act, sought a writ of mandamus compelling the same action. Although pleaded separately, these claims collectively alleged that defendants’ delays constituted “agency action unlawfully withheld or unreasonably delayed” within the meaning of § 706(1). 

The case was originally assigned to District Judge Christina A. Snyder and Magistrate Judge Jacqueline Chooljian, but on June 20, 2024, it was reassigned to District Judge Fred W. Slaughter pursuant to the Central District’s general order for related case assignments. 

On August 2, 2024, the government filed a motion to dismiss, arguing that visa-processing timelines are committed to agency discretion and therefore unreviewable under the Administrative Procedure Act (APA). Plaintiffs filed their opposition on September 4, and the government replied on September 12. On September 23, 2024, Judge Slaughter issued a scheduling notice setting a hearing on the motion for October 7, but later vacated the hearing and took the matter under submission without oral argument.

While the dismissal motion remained pending, plaintiffs filed a motion for preliminary injunction on November 20, 2024, seeking an order requiring the State Department to adjudicate their immigrant-visa applications within thirty days. The government filed its opposition on December 2, plaintiffs filed their reply on December 17, and the court held oral argument on December 19. During this same period, several plaintiffs who had received visas filed voluntary dismissals of their individual claims.

On December 26, 2024, Judge Slaughter issued a combined ruling granting in part and denying in part the government’s motion to dismiss and denying plaintiffs’ motion for a preliminary injunction. Judge Slaughter dismissed Count I (the DS-5535 policy) with prejudice, holding that the timing and manner of collecting DS-5535 information is committed to agency discretion under 8 U.S.C. § 1202(a) and therefore unreviewable under the APA. Count II (the § 221(g) policy) was likewise dismissed with prejudice after plaintiffs failed to oppose the government’s arguments. Counts III through VI, which alleged unreasonable delay and sought mandamus relief, were dismissed without prejudice as to the two plaintiffs residing in the Central District of California. The court found that delays of approximately six to fourteen months were not unreasonable under the TRAC factors, explaining that the delays were relatively short, occurred in the context of complex security vetting and limited consular resources, and caused no specific hardship beyond normal administrative delay.

Judge Slaughter also severed all other plaintiffs’ claims under Rule 20(a), concluding that their visa applications arose from different consular posts and factual settings and therefore did not satisfy the rule’s permissive-joinder requirements. Because only Pouya Ariani and Ali Mikaniki resided within the Central District, venue was proper solely for their claims. The court directed all other plaintiffs to elect by January 10, 2025 whether to dismiss without prejudice or transfer to the District of Columbia or to their home districts. Finally, Judge Slaughter denied preliminary injunctive relief, holding that the plaintiffs had not shown a likelihood of success on the merits and that the alleged harm from administrative delay did not outweigh the government’s interests in national-security screening and resource allocation.

On December 30, 2024, plaintiffs’ counsel filed a collective notice electing transfer of the severed plaintiffs’ claims to the District of Columbia rather than dismissal. On January 7, 2025, Judge Slaughter granted that request and ordered transfer of those claims under 28 U.S.C. § 1406(a). Although the court had initially dismissed the two local plaintiffs’ claims without prejudice, their claims were included in the same transfer, consolidating all surviving plaintiffs in one forum. 

The Central District docket was terminated when the consolidated case—retaining the Ariani v. Blinken caption—was docketed in the U.S. District Court for the District of Columbia on February 7, 2025, before Judge Tanya S. Chutkan. At transfer, the case comprised roughly seventy-eight plaintiffs, of whom about seventy-six elected transfer to D.C., while only a few opted for dismissal without prejudice. 

After transfer, the government obtained an extension of time and filed its answer on March 7, 2025. On March 26, the government moved for judgment on the pleadings and, in the alternative, to sever remaining plaintiffs. Plaintiffs opposed on April 10, and defendants replied on April 14. 

During the summer, several waves of voluntary dismissals occurred between May 27 and July 3, 2025, as individual plaintiffs’ visa applications were adjudicated. The case remains pending before Judge Chutkan, with additional briefing continuing into fall 2025, and approximately sixty plaintiffs still pursuing relief.

Cal. 1995), Horne v. Wells Fargo Bank, N.A., 969 F. Supp. 2d 1203 (C.D. Cal 2013), and In re Intermagnetics Am., Inc., 101 B.R. 191 (C.D. Cal. 1989). Based on the state of the record, as applied to the applicable law, the court finds good cause to grant the relief requested by the parties in the Applications. See Mission Power Engg Co., 883 F. Supp. at 489 (stating that to be proper, an ex parte application must demonstrate that there is good cause to allow the moving party to go to the head of the line in front of all other litigants and receive special treatment); Ahanchian v. Xenon Pictures, Inc., 624 F.3d 1253, 1259-61 (9th Cir. 2010) (discussing good cause standard in the context of motions seeking to continue deadlines under Rule 6(b)(1)); Horne, 969 F. Supp. 2d at 1205 (stating ex parte relief is justified where the party seeks a routine procedural order that cannot be obtained through a regularly noticed motion, such as a request to file an overlong brief).
