In this case, the Trump Administration challenged the State of Oregon’s alleged violation of federal voting laws.  This is one of several cases seeking voter data from state election officials.  Here are all of the DOJ Voter Data lawsuits in the Clearinghouse collection. 

The U.S. Department of Justice, Civil Rights Division (DOJ) is tasked with ensuring that States conduct voter registration list maintenance “to prevent inclusion of ineligible voters on any State’s voter registration list.” On July 16, 2025, citing, among other things, a high ratio of registered voters to voting aged citizens in the State of Oregon and alleging lack of compliance by the State, DOJ requested details regarding the State of Oregon’s compliance with voter registration list maintenance processes and the lists themselves. In a response letter sent on August 21, Oregon’s Secretary of State, Tobias Read, allegedly refused to comply with all of DOJ’s demands.

On September 16, 2025 the United States (Plaintiff) brought this action against the State of Oregon to remedy the state's alleged violations of federal voting laws, filing under the National Voter Registration Act (NVRA), the Help America Vote Act (HAVA), and Title III of the Civil Rights Act of 1960 (CRA). The U.S. sought to compel the State of Oregon and its chief state election official, the Secretary of State, to provide information regarding the State of Oregon’s voter list maintenance procedures and an electronic copy of its statewide voter registration list; the federal government said this information was needed to assess Oregon’s compliance with the voter roll cleanup requirements of the NVRA, HAVA, and Title III of the CRA. The case was assigned to Judge Mustafa T. Kasubhai. 

On September 26, Our Oregon, and several individual voters filed a Motion to Intervene as Defendants. Our Oregon, an organization that “fights for economic and social fairness for all Oregonians” and the other intervenors, all “civically-engaged registered Oregon voter[s],” sought to intervene to preserve privacy rights of themselves and other Oregonians. 

Defendants filed a motion to dismiss for failure to state a claim on November 17. They argued that neither the NVRA nor HAVA required defendants to produce the sensitive information that plaintiffs requested and that plaintiffs had incorrectly invoked Title III of the CRA in this case because the CRA could not be invoked to investigate issues unrelated to civil rights.

This case is ongoing.

ORDER by Judge Mustafa T. Kasubhai: The Court is aware of correspondence from Attorney General Pamela Bondi addressed to Minnesota Governor Tim Walz, dated January 24, 2026. The letter explains, inter alia, the purported reason for ICE enforcement activities in Minnesota. The letter further urges Governor Walz to cooperate with the Department of Justice on three points, one of which is to "allow the Civil Rights Division of the Department of Justice to access voter rolls to confirm that Minnesota's voter registration practices comply with federal law as authorized by the Civil Rights Act of 1960." The letter explains that "[f]ulfilling this common sense request will better guarantee free and fair elections and boost confidence in the rule of law." The Court orders counsel to appear by videoconference at 3:00pm PST on January 26, 2026, to provide supplemental argument on the relevance of this letter in interpreting "basis and purpose" in the context of Plaintiff's claim under Title III of The Civil Rights Act of 1960 in this case.
