This case challenged the Trump Administration Department of Health and Human Services' (HHS) threat to revoke funding for sex education programs that include gender ideology.  

On September 26, 2025, a group of 16 states and Washington DC sued HHS for revoking or threatening to revoke funds provided under two programs for adolescent sex education. The two programs, the Personal Responsibility Education Program (PREP) and Title V Sexual Risk Avoidance Education Program (SRAE), provide funding to sex education programs that are "medically accurate and complete," incorporate evidence-based programs shown to change adolescent sexual behavior, age-appropriate, and culturally appropriate. Congress's goal in establishing these programs was to reduce pregnancy and sexually-transmitted diseases among teens. The plaintiffs stated that they include education aimed at transgender teens in these programs to accurately provide them with sexual health education, and that providing gender-inclusive health education helps in other ways such as reducing bullying. 

On August 26, 2025, the plaintiff states received a letter from HHS stating that their curriculum was out of compliance with the PREP statute because gender ideology education is "outside the scope of the statutory authority for this award" and gave the plaintiffs 60 days to come into compliance by removing "all content concerning gender ideology." Plaintiffs alleged that they would lose $35 million if their PREP and SRAE funding was terminated. This puts them in the untenable situation of being forced to either lose federal funding for their programs, or comply with what they allege is an unlawful funding condition. Further, some of the plaintiff states have laws in place prohibiting discrimination against transgender youth or requiring gender-inclusive sex education, so they would have to choose between complying with the federal demands, or their own laws. 

Plaintiffs allege that HHS's actions violate the Administrative Procedure Act (APA) in two main ways. First, the curriculum demands are contrary to law because the authorizing statutes require the programs to be medically accurate and complete, and that removing materials about gender identity would make the programs medically inaccurate. Second, the demands are arbitrary and capricious because the only explanation given, that gender ideology education is outside the scope of the statute, is inconsistent with the text of the statute and medical evidence; the justification is a pretext for their desired outcome; these demands are inconsistent with prior HHS actions; contradicts HHS' position on discrimination (which includes gender identity); and HHS did not consider the impact of the change in policy on the grantees. Plaintiffs also allege that the demands violate the Spending Clause because the funding conditions were imposed retroactively; the language of the conditions is vague as "gender ideology" is not defined by the letters; and it violates the principle that only Congress can impose conditions on funding. Lastly, the plaintiffs argue this violates Separation of Powers because Congress has spending power, and not the Executive Branch. 

On September 26, 2025, plaintiffs also filed a motion for a Preliminary Injunction that would prevent HHS from enforcing the PREP and SRAE funding freezes. This case is in front of Judge Ann L. Aiken. 

On October 27, 2025, Judge Aiken granted the preliminary injunction, finding that the plaintiffs were "likely to succeed on at least one claim if not all of them." 2025 WL 3002366. First, the court held that the spending conditions were in excess of HHS's statutory authority because (1) the conditions violate the Appropriations Clause of the Constitution, which prevents the executive branch from attaching conditions to funds authorized by Congress, (2) Congress intended for the PREP and SRAE programs to incorporate evolving understandings of sexual risk avoidance, counter to HHS's argument that Congress wanted to "anchor the programs in traditional understandings," (3) the authorizing statute does not give HHS the authority to redefine what is "medically accurate and complete," and (4) HHS's attempt to exclude gender identity curriculum conflicted with Congress's requirement that the programs be "culturally appropriate" and target "high risk youth."

Second, the court held that the funding conditions were arbitrary and capricious under the APA because (1) when HHS determined that gender identity is not relevant to the educational goals of PREP and SRAE, they did not consider the statutory requirements and relevant data, (2) HHS changed their position without providing a reason or considering the plaintiffs' reliance interests, (3) the funding conditions violate a federal law that prohibits discrimination on the basis of sex under federal grant programs (which was actually in line with HHS's own previous interpretation, which includes sexual orientation and gender identity discrimination as covered by the law), and (4) the funding conditions are a pretext to implement the administration's policy preferences. 

The court additionally held that the plaintiffs were likely to succeed on showing the agency action is contrary to constitutional right, because the funding conditions violated both the Separation of Powers doctrine, and the Spending Clause. The court first determined the funding conditions violate the Separation of Powers doctrine because the power to attach conditions to federal funding belongs to Congress, and not the executive. HHS thus violated Separation of Powers by attaching funding conditions that were not related to the purpose of the PREP and SRAE statutes. The court then held the funding conditions violated the Spending Clause because HHS did not define "gender ideology" in their communications with the states, thus violating the Spending Clause by attaching an ambiguous condition to funding. 

The court determined that the plaintiffs were likely to suffer irreparable harm from the loss of funds because it would impair their ability to deliver medically accurate and complete sexual education to youth and thus impair their ability to protect public health. The court lastly determined the public interest was served by granting the preliminary injunction, reiterating the reasons it found the plaintiffs were likely to succeed on the merits. The court thus enjoined HHS from enforcing the funding conditions and declared any actions already taken to implement them as null, void, and rescinded. 

This case is currently ongoing.
