On September 26, 2025, a group of 16 states and the District of Columbia sued HHS for revoking or threatening to revoke funds provided under two adolescent sex education programs: the Personal Responsibility Education Program (PREP) and the Title V Sexual Risk Avoidance Education Program (SRAE). Both programs fund sex education curricula that are "medically accurate and complete," proven to change youths' sexual behavior, age-appropriate, and culturally appropriate. Congress's goal in establishing these programs was to reduce pregnancy and sexually transmitted diseases among teens. Plaintiffs stated that they include education aimed at transgender teens to provide accurate sexual health information, and that gender-inclusive health education also reduces harms such as bullying.

On August 26, 2025, plaintiffs received a letter from HHS declaring their curriculum out of compliance with the PREP statute and giving them 60 days to come into compliance by removing "all content concerning gender ideology" before HHS terminated their PREP and SRAE funding. HHS claimed that plaintiffs’ gender ideology education was "outside the scope of the statutory authority for this award." Plaintiffs stated that they would lose $35 million if their PREP and SRAE funding was terminated. This forced them to choose between losing federal funding and complying with what they alleged was an unlawful condition. Moreover, several plaintiff states prohibit discrimination against transgender youth or require gender-inclusive sex education, forcing them to choose between federal demands and their own state law.

Plaintiffs alleged that HHS's actions violated the Administrative Procedure Act (APA) in two main ways. First, the curriculum demands were contrary to law because the authorizing statutes required the programs to be medically accurate and complete, and removing materials about gender identity would make the programs medically inaccurate. Second, the demands were arbitrary and capricious because HHS’s only explanation for its actions, that gender ideology education is outside the scope of the statute, was inconsistent with the text of the statute and medical evidence. Plaintiffs alleged the justification was a pretext for a desired policy outcome, that the demands were inconsistent with prior HHS actions, that they contradicted HHS's own position that discrimination based on sex includes gender identity, and that HHS failed to consider the policy change's impact on grantees. Plaintiffs also alleged that the demands violated the Spending Clause because the conditions were imposed retroactively; the conditions were impermissibly vague, as "gender ideology" was not defined in the letters; and the conditions violated the principle that only Congress may attach conditions to federal funding. Finally, plaintiffs argued that this violated the Separation of Powers because the spending power belongs to Congress, not the Executive Branch.

On September 26, 2025, plaintiffs also filed a motion for a preliminary injunction that would prevent HHS from enforcing the PREP and SRAE funding freezes. This case is before U.S. District Judge Ann L. Aiken.

On October 27, 2025, Judge Aiken granted the preliminary injunction, finding that plaintiffs were "likely to succeed on at least one claim if not all of them." 2025 WL 3002366. First, the court held that the spending conditions were in excess of HHS's statutory authority because (1) the conditions violated the Spending Clause of the Constitution, which prevents the executive branch from attaching conditions to funds authorized by Congress, (2) Congress intended for the PREP and SRAE programs to incorporate evolving understandings of sexual risk avoidance, counter to HHS's argument that Congress wanted to "anchor the programs in traditional understandings," (3) the authorizing statute did not give HHS the authority to redefine what is "medically accurate and complete," and (4) HHS's attempt to exclude gender identity curriculum conflicted with Congress's requirement that the programs be "culturally appropriate" and target "high risk youth."

Second, the court held that the funding conditions were arbitrary and capricious under the APA because (1) when HHS determined that gender identity is not relevant to the educational goals of PREP and SRAE, it did not consider the statutory requirements and relevant data, (2) HHS changed its position without providing a reason or considering plaintiffs' reliance interests, (3) the funding conditions violated a federal law that prohibits discrimination based on sex under federal grant programs (consistent with HHS's own prior interpretation that the law covers sexual orientation and gender identity discrimination), and (4) the funding conditions were a pretext to implement the administration's policy preferences.

The court additionally held that plaintiffs were likely to succeed on showing the agency action is contrary to constitutional rights, because the funding conditions violated both the Separation of Powers doctrine and the Spending Clause. The court first held that the funding conditions violated the Separation of Powers doctrine because the power to attach conditions to federal funding belongs to Congress, not the executive. HHS therefore exceeded its authority by attaching conditions unrelated to the purpose of the PREP and SRAE statutes. The court then held that since HHS did not define "gender ideology" in its communications with the states, it violated the Spending Clause by attaching an ambiguous condition to funding.

The court determined that plaintiffs were likely to suffer irreparable harm from the loss of funds because it would impair their ability to deliver medically accurate and complete sexual education to youth and thus impair their ability to protect public health. Finally, the court determined that granting the preliminary injunction served the public interest, reiterating its reasons for finding plaintiffs likely to succeed on the merits. The court thus enjoined HHS from enforcing the funding conditions and declared null, void, and rescinded any actions HHS had already taken to implement them.

On December 26, 2025, HHS appealed the preliminary injunction order to the United States Court of Appeals for the 9th Circuit. In its February 25, 2026 opening brief, it argued that the preliminary injunction should be vacated because the district court "provided no basis for concluding that the PREP and SRAE statutes preclude any limits on the gender content included in curricula under those programs," and because the remedy was overbroad, infringing on HHS's authority to enforce curricular limitations. Plaintiffs' April 27 response argued that the district court properly concluded that HHS's categorical ban on any mention of gender identity was incompatible with congressional intent in both PREP and SRAE. Oral argument is scheduled for September 14, 2026.

In the district court, HHS moved for summary judgment on January 30, 2026, arguing that a plain reading of the PREP and SRAE statutes clearly demonstrates that gender ideology content does not fit into their Objective Requirements because it is not designed to educate students on abstinence, contraception, adulthood preparation, or sexual risk avoidance. HHS asserted that these were threshold requirements, and that there was no need to consider the additional requirements of medical accuracy and cultural appropriateness because the content failed at the first hurdle. Therefore, it contended that plaintiffs' claims failed under a plain reading of the statutes.

Plaintiffs responded to HHS's summary judgment motion on February 20, 2026, advancing arguments similar to those in the complaint and reiterating that gender identity content was essential to fulfill the statutes' requirements. They also filed a summary judgment motion of their own the same day, requesting that the court vacate the gender conditions, permanently enjoin HHS from enforcing them or any materially similar terms, and issue a declaratory judgment that the statutes do not prohibit gender identity curricula.

This case is currently ongoing.
