On September 30, 2025, the League of Women Voters, the Electronic Privacy Information Center (EPIC), and five individuals filed this lawsuit in the U.S. District Court for the District of Columbia against the Department of Homeland Security (DHS), the Social Security Administration (SSA), the Department of Justice (DOJ), and their agency heads. 2025 WL 2797681. Plaintiffs, represented by private counsel, challenged DHS's transformation of the SAVE system from a tool used primarily to verify the immigration status of noncitizens into a system capable of querying the records of U.S.-born citizens using Social Security numbers. Plaintiffs alleged that, pursuant to Executive Order 14,248 and other presidential directives, Defendants integrated SSA's Master File into SAVE and added bulk search capabilities, enabling state election officials to verify voter eligibility by searching large numbers of voter-registration records at once. Plaintiffs alleged that Defendants violated the Privacy Act's computer-matching requirements and System of Records Notice provisions, that Defendants' actions were arbitrary and capricious under the Administrative Procedure Act (APA), and that those actions were ultra vires and violated the Separation of Powers. The case was initially assigned to District Judge James Boasberg but was later reassigned to District Judge Sparkle L. Sooknanan.

On October 7, 2025, Plaintiffs moved for a preliminary injunction and a stay under Section 705 of the APA. On October 10, 2025, the court granted the individual Plaintiffs' motion to proceed pseudonymously due to risks of retaliation. Plaintiffs also moved to certify a preliminary relief subclass but withdrew that motion on October 29, 2025. Defendants opposed the motion for a preliminary injunction and stay, arguing that Plaintiffs lacked Article III standing because their alleged privacy and voting-rights injuries were speculative and not fairly traceable to federal actions. Defendants further contended that Plaintiffs could not use the APA to circumvent the Privacy Act's remedial scheme, which generally limits relief to monetary damages, and that Plaintiffs had failed to demonstrate irreparable harm, citing their delay in filing suit and the absence of concrete evidence of voter disenfranchisement.

On November 17, 2025, Judge Sooknanan denied the motion for a preliminary injunction and a stay, holding that although Plaintiffs had raised serious questions regarding the lawfulness of the government's actions, they failed to demonstrate irreparable harm from potential voter disenfranchisement or privacy injuries. The court ordered the parties to propose an expedited schedule to resolve the case on the merits.

On June 22, 2026, Judge Sooknanan granted summary judgment to Plaintiffs, holding that the SAVE overhaul violated the Privacy Act, the Social Security Act, and the APA. The court set aside the agency actions implementing the modified SAVE system and the related System of Records Notices. Defendants appealed to the U.S. Court of Appeals for the D.C. Circuit, and on July 8, 2026, the district court denied Defendants' motion to stay the judgment pending appeal. 2026 WL 1972055. The appeal remains pending before the D.C. Circuit.
