This case concerns a challenge to the Environmental Protection Agency’s (EPA) decision to terminate the multi-billion-dollar Solar for All program, which may result in almost a million low-income households across the country losing access to affordable solar power, and hundreds of thousands of jobs being lost.

On October 16, 2025, a coalition of twenty-one states, the District of Columbia, and two state agencies filed suit in the Western District of Washington against the EPA over its decision to terminate the Solar for All (SFA) program – a program designed to bring low-cost distributed solar energy to over 900,000 households in low-income and disadvantaged communities. The plaintiffs claimed the EPA acted in violation of the Administrative Procedure Act (APA) by erroneously applying and interpreting H.R. 1 of the “One Big Beautiful Bill Act” to unlawfully terminate the SFA program and to deobligate all remaining SFA funds. The plaintiffs further alleged that the termination was unconstitutional because it violated the Separation of Powers and the Spending Clause of the Constitution. 

The plaintiffs sought injunctive and declaratory relief, requesting the Court to “1) declare that the H.R. 1 Interpretation, the Program Termination Directive, and the Deobligation Directive are unlawful and should be vacated; 2) grant injunctive relief prohibiting EPA from implementing the H.R. 1 Interpretation, Program Termination Directive, and Deobligation Directive; and 3) order EPA to reinstate the SFA Program and perform the necessary administrative support to the Program and SFA Recipients.” The case was assigned to District Judge Tiffany M. Cartwright. 

On November 14, 2025, the plaintiffs filed a motion for a preliminary injunction. The States requested that the Court freeze the SFA funds and prevent the forced closeout of their grants, asserting that the EPA's actions threatened irreparable harm and the permanent loss of the congressionally appropriated funding. The plaintiffs contended that the proposed preliminary injunction would preserve the availability of the funds while the underlying lawsuit proceeded.

On November 19, 2025,  the defendants filed a motion to transfer this case to the U.S. District Court for the District of Columbia. They argued that the transfer was appropriate because a "substantively identical lawsuit," Harris County v. U.S. Environmental Protection Agency, was filed three days earlier in the District of Columbia, making the current case suitable for transfer and consolidation under the "first-to-file" rule or the statutory interests of justice and convenience, thereby preventing contradictory judgments and conserving judicial resources.

On January 7, 2026, the Court denied the defendants’ motion to transfer. The Court determined that transferring the venue was unnecessary despite a similar case being filed earlier in Washington, D.C., because the parties involved were not sufficiently similar. Furthermore, the court emphasized that Washington State serves as a lead plaintiff with significant local interests, making the current forum appropriate. 

On January 13th, after a motion hearing, the Court denied plaintiffs’ motion for preliminary injunction. The Court issued the ruling and underlying reasoning orally, and the transcript for the hearing is currently unavailable. 

On February 19, 2026, the plaintiffs filed an amended complaint, which added the Commonwealth of Virginia as a plaintiff and asserted that the rescission of administrative cost funds under H.R. 1 did not deprive the EPA of the financial means to continue implementing the SFA Program, given Congress’s original appropriation language. On February 24, the plaintiffs filed a motion for summary judgment, asserting that the defendants had no authority to terminate the SFA funds under H.R. 1. On March 17, the defendants filed a cross-motion for summary judgment which claimed that the plaintiffs could only challenge grant terminations, such as in the instant case, in the Court of Federal Claims.

On June 1, 2026, the court denied the plaintiffs’ motion for summary judgment and granted the defendants’ motion for summary judgment, dismissing the plaintiffs’ claims without prejudice. The court held that since the plaintiffs’ claims are contractual in nature, the Tucker Act vests exclusive jurisdiction over them in the Court of Federal Claims.
