This case challenges U.S. Immigration and Customs Enforcement (ICE’s) systematic pattern of illegal arrests across the state of Colorado, including through workplace raids, roadside stops, and detention of undocumented residents with valid driver's licenses.

On October 9, 2025, this putative class suit was filed in the U.S. District Court for the District of Colorado against Kristi Noem in her capacity as the Secretary of the Department of Homeland Security (DHS), Todd M. Lyons as the Acting Director of ICE, and Robert Guadian as the Director of ICE’s Denver Field Office. Plaintiffs are four Latine individuals who were arrested by ICE without a warrant or warning. The plaintiffs brough this suit on behalf of  the following proposed class:“All persons since January 20, 2025, who have been arrested or will be arrested in this District by ICE without a warrant and without a pre-arrest, individualized assessment of probable cause that the person poses a flight risk.” Plaintiffs are represented by the ACLU of Colorado, Meyer Law Office, and Olson Grimsley Kawanabe Hinchcliff & Murray LLC. 8 U.S.C. § 1357(a)(2) and 8 C.F.R. § 287.8(c)(2)(ii) respectively require that ICE agents have “reason to believe” that individuals are in violation of U.S. immigration law before making arrests, and that they’d be “likely to escape before a warrant [could] be obtained for [their] arrest.” Plaintiffs allege that ICE did not follow either of these procedures, instead targeting people based on assumptions about their demographics, including the color of their skin, their accent, and where they live and work. Plaintiffs allege that ICE thereby violated the Administrative Procedure Act (APA) with actions that were ultra vires and in excess of their statutory authority. Their prayer for relief included class certification, declaratory and injunctive relief, and attorneys’ fees and costs.

On the same day as the complaint, Plaintiffs filed a motion for preliminary injunction, asking that the court certify a class and issue a class-wide injunction that requires ICE to comply with its legal duties in the state of Colorado.

The case was assigned to Judge Robert E. Blackburn, but quickly reassigned for judgment on the merits to Judge R. Brooke Jackson and Magistrate Judge Cyrus E. Chung.

On October 20, 2025, the parties submitted a joint motion for the entry of a protective order due to the confidential nature of some information in the case. The motion was granted the next day.

Defendants responded to the motion for preliminary injunction on October 29, 2025, arguing that Plaintiffs (1) had no standing because they were not under immediate threat of experiencing an unlawful arrest and were only arrested in the past, (2) did not make a valid APA claim because “the policy, pattern, and/or practice of making warrantless arrests” does not count as a “final agency action,” (3) did not prove that ICE was ignoring requirements while making arrests, and (4) did not demonstrate that they would suffer irreparable harm without the preliminary injunction. They further argued that the court does not have the authority to issue the universal injunction that Plaintiffs sought.

On November 6, 2025, Defendants submitted a motion to restrict remote electronic access to the case file in the case or, in the alternative, submitted a protective order specifically restricting remote public access to the declaration of Gregory Davies, an ICE official in Denver. Plaintiffs opposed the former motion, but not the latter protective order.

Judge R. Brooke Jackson issued an order on November 25, 2025 (1) granting class certification, (2) granting in part and denying in part Plaintiffs' motion for preliminary injunction, (3) granting in part and denying in part Defendant’s motion to restrict remote electronic access, (4) granting Plaintiffs' attorneys' fees and costs, and (5) compelling parties to agree upon a schedule for the case. 2025 WL 3293467. Plaintiffs met the burden of proof for their PI motion, though the court narrowly tailored their remedy to the harm. The court ordered the release and restoration of two plaintiffs to their state pre-arrest, and that ICE agents follow the procedure to only arrest with probable cause. They further required ICE agents to document the circumstances surrounding each arrest when filling out their Form I-213, and that, at some agreed-upon interval, they must provide Plaintiff’s counsel a random subset of Form I-213s to survey for warrantless arrests. For the Defendants' motion to restrict electronic access, the court denied a restriction to the entire case file, but approved the protective order on the declaration of Gregory Davies.

MINUTE ORDER: The Court has read the parties Joint Status Report as to the Evidentiary Hearing [ECF No. 73]. The central point of contention is whether the upcoming hearing regarding defendants alleged noncompliance with the courts preliminary injunction order should include evidence of arrests where the noncitizen was encountered in the field with no warrant (i.e., they were a "collateral"), and then the ICE or other DHS agent obtained a warrant over the phone or otherwise after they initially stopped them but before they brought them to the field office for processing. Plaintiffs argue that [d]eclining even to allow evidence on this issue would provide a blueprint for Defendants to evade this Courts order and the statute ECF No. 73 at 2. This Court agrees that is a risk. In its PI Order, the Court specifically found that for arrests made without a flight risk assessment, warrants issued after-the-fact do not bring the arrest within the color of law. ECF No. 73 at 5. Plaintiffs allege that is, in effect, what defendants are doing. Furthermore, if these arrests are, in practice, happening before the field warrant is issued, it raises the question of whether ICE is impermissibly redefining "likelihood of escape" to find probable cause to detain until the warrant is obtained. Therefore, the Court will hear evidence about this alleged practice in order to determine, inter alia: (1) what is actually happening in the course of these so called field warrant arrests; (2) how pervasive this practice is; (3) whether the agency has trained and encouraged its agents to make arrests in this fashion following the Courts order; and (4) how these arrests are being documented. The Court has read and reviewed defendants position that these arrests, if they are happening, are not the appropriate subject of this hearing because, in their view, it would expand the scope of both the plaintiffs case and the Courts order certifying a provisional class and preliminary injunction order. ECF No. 73 at 5-11. The Court is not convinced, at least at this stage and without having heard the evidence or full argument, that the alleged field warrant arrests are so outside the scope of the complaint, the evidence adduced at the PI hearing, and the Court's preliminary rulings, that they are not the proper subject of this case and of a compliance order.
