This case challenges the constitutionality of California’s new congressional district maps that impermissibly favors Hispanic voters. 

In August 2025, President Trump allegedly placed pressure on Republican-led states to redraw their congressional maps to boost the party’s chances within the 2026 midterms. As a result, many Republican-led states began a mid-decade redraw of their own congressional maps. In response to these unprecedented mid-decade redraws, California threatened to respond in kind if those states bowed to President Trump’s demands. This led to the California legislature to enact a legislation that would permit mid-decade redistricting, known as Proposition 50, which was overwhelmingly approved by Californian voters in the November 2025 elections. 

On November 5, a group of California voters and the California Republican Party filed this lawsuit in the U.S. District Court for the Central District of California against Gavin Newsom, the Governor of California, and Shirley Weber, the Secretary of State. Represented by a private law firm, Plaintiffs alleged that California’s congressional district maps violated the Fourteenth and Fifteenth Amendment rights because the map was intentionally and directly drawn using race-based classifications that favored Hispanic voters. Plaintiffs claimed that though the Voting Rights Act (VRA) authorizes race-based districting when there is evidence that the minority race group has not been able to elect its preferred candidate, there was no proof that Hispanic voters have not been able to do so here. Plaintiffs sought preliminary and permanent injunction, as well as declaratory judgment. Plaintiffs subsequently filed a motion for preliminary injunction given that the infringement on the right to vote is an irreparable injury and subject to immediate relief. 

This case was originally assigned to District Judge Josephine L. Staton and Magistrate Judge Karen E. Scott. On November 12, Judge Staton granted the Democratic Congressional Campaign Committee’s (DCCC) unopposed motion to intervene. The DCCC alleged that it has a right to intervene because of its direct interest in the validity of the congressional maps, its prior support of Proposition 50, and in order to rebut the allegations that Plaintiffs made against the DCCC in their brief. Additionally, Judge Staton granted the United States of America’s motion to intervene. The government filed a complaint in intervention claiming that the Congressional redistricting constitutes racial gerrymandering in violation of the Equal Protection Clause of the Fourteenth Amendment and in violation of Section 2 of the Voting Rights Act. They also filed a separate motion for a preliminary injunction, which introduced new factual evidence and raised arguments that were similar to, but distinct from, arguments in Plaintiffs’ motion. 

On November 13, the U.S. Court of Appeals for the Ninth Circuit, per request of Judge Staton, appointed a three-judge district court panel to preside over the remainder of the proceedings. This panel was composed of Judge Staton, Judge Wesley L. Hsu (U.S. District Judge for the Central District of California), and Judge Kenneth Kiel Lee (U.S. Circuit Judge for the Ninth Circuit). 

On November 15,  the League of United Latin American Citizens (LULAC) moved to intervene. Represented by Arnold & Porter Kaye Scholer LLP, Democracy Defenders Action and Justice Legal Strategies PLLC, LULAC alleging that Proposition 50 was not racial gerrymandering but rather partisan gerrymandering that marginally increased Latino voting strength. Additionally, on November 17, the Cervantes Intervenors – a group of registered Latino, Democratic voters – moved to intervene because they alleged that their vote for Proposition 50 will be unlawfully denied if the court strikes down the congressional map. 

Given the Western District of Texas’s recently issued 160-page order in the case regarding the constitutionality of Texas’s newly enacted congressional map, Defendants and Defendant-Intervenors requested the court modify the briefing and hearing schedule. In response, the court moved the pending hearing to December 15, 2025. 

On January 14, 2026, the court denied Plaintiffs' motion for a preliminary injunction. The court found that voters enacted the map as an explicit partisan response to Texas redistricting, intending to flip five congressional seats to Democrats. Although legislators and the mapmaker evinced race-consciousness in statements regarding the map lines, because the electorate intent was partisan, the court concluded Plaintiffs failed to demonstrate a likelihood of success on the merits.

On January 20, Plaintiffs sought an emergency application to the Supreme Court to enjoin the Proposition 50 map, saying the district court erred in prioritizing voter intent over the mapmaker's racial motivation, and asked for the 2021 map's reinstatement pending appeal. On February 4, the Court denied the emergency application.

On February 11, Defendants and Defendant-Intervenors filed motions to dismiss. 

Meanwhile, another case challenging the constitutionality and legality of California’s new Congressional district map, Noyes v. Newsom, No. 2:25-cv-11480-JLS-WLH-KKL, was pending in the same court. On March 20, after reviewing the parties’ filings, the court ordered the consolidation of Noyes and Tangipa (this case) for all future proceedings, finding that the two actions raise common questions of law and fact. 

Pursuant to the Supreme Court’s ruling, plaintiffs successfully stipulated to dismiss their appeal. As of March 28, 2026, this case is ongoing.
