On November 15, 2024, a Palestinian Muslim former student of Northwestern University Pritzker School of Law (Northwestern Law) filed suit in the Circuit Court of Cook County, Illinois, against the law school, certain administrators, the Northwestern University Police Department, several media entities, two fellow law students, and unidentified John and Jane Doe defendants. Soon thereafter, the case was removed to the U.S. District Court for the Northern District of Illinois. The plaintiff asserted claims under Title VI of the Civil Rights Act (intentional discrimination and hostile environment), Title VI and Title VII of the Civil Rights Act (deliberate indifference), as well as state-law claims for defamation per se, defamation, false light, commercial disparagement, negligence, breach of contract, and breach of the implied covenant of good faith and fair dealing. The plaintiff sought damages and attorneys’ fees. The case was assigned to Judge Charles P. Kocoras.

In the complaint, the plaintiff alleged that Northwestern Law and its administrators violated Title VI by deliberately ignoring repeated reports of harassment and false criminal accusations targeting her as a Palestinian Muslim student, thereby creating a hostile educational environment and causing her to lose her job offer at DLA Piper. She also brought state-law claims against fellow students and media outlets, alleging that they knowingly published false statements portraying her as criminal and unhinged, leading to substantial harm, including lost professional opportunities and diminished salary. Finally, she claimed that Northwestern Law breached its express and implied contractual obligations by selectively enforcing anti-discrimination and anti-harassment policies, failing to protect her from harassment and false allegations, and treating complaints from Middle Eastern and Muslim students more leniently than complaints from other groups, resulting in ongoing harm to her education, career, and well-being.

On January 10, 2025, Northwestern Law filed a motion to dismiss for failure to state a claim. The plaintiff thereafter filed an agreed motion to sever and remand state-law claims and to amend the case caption to reflect properly named defendants. The court granted this motion on January 31, 2025.

The plaintiff filed a first amended complaint on February 7, 2025. The amended pleading removed several defendants (including Northwestern Law, the Northwestern University Police Department, multiple media organizations, the two individual students, and the unnamed defendants), added Northwestern University, and retained the three law school deans as defendants. The amended complaint also withdrew the Title VII deliberate indifference claim and all claims for defamation, false light, commercial disparagement, and negligence, asserting only claims under Title VI (intentional discrimination, hostile environment, and deliberate indifference), along with claims for breach of contract and breach of the implied covenant of good faith and fair dealing.

The defendants filed a motion to dismiss the first amended complaint on February 28, 2025. On March 24, 2025, the plaintiff filed a notice voluntarily dismissing, without prejudice, the breach of contract and breach of the implied covenant of good faith and fair dealing claims.

On May 13, 2025, the court granted in part and denied in part the defendants’ motion to dismiss. The court allowed the Title VI intentional discrimination claim to proceed, finding that the plaintiff’s allegations of repeated complaints and different treatment compared to students outside her protected class plausibly supported an inference of intentional discrimination. However, the court dismissed the hostile educational environment and deliberate indifference claims without prejudice, finding the alleged conduct was not sufficiently severe or pervasive, and did not deprive the plaintiff of educational opportunities or show deliberate indifference by the university. 2025 WL 1384291.

The plaintiff filed a second amended complaint on June 6, 2025. The revised complaint added extensive new allegations regarding a fellow student’s violent social media posts against Palestinians, Northwestern's failure to take disciplinary action despite safety complaints, and the plaintiff's inability to attend classes safely (resulting in deferred exams and accelerated completion requirements). It also consolidated the Title VI claims into two counts focused on intentional discrimination and hostile educational environment, eliminating the separate deliberate indifference claim.

On July 15, 2025, the defendants filed a motion to dismiss the second amended complaint, which the court granted on November 3, 2025. The court dismissed the Title VI claims against the defendant deans with prejudice, holding that employment alone did not make them recipients of federal funds. It also dismissed the Title VI hostile environment claim without prejudice against Northwestern, finding that the plaintiff failed to show deliberate indifference, and dismissed the Title VI intentional discrimination claim without prejudice, noting that the plaintiff did not identify a similarly situated individual outside her protected class who received the relief she sought. 2025 WL 3062790.

The plaintiff filed a third amended complaint on December 16, 2025, removing the three defendant deans, expanding allegations of classroom discrimination by professors, and adding allegations intended to demonstrate actual notice and deliberate indifference by university administrators.

On March 6, 2026, Northwestern filed a motion for judgment on the pleading. 

This case is ongoing as to the Title VI intentional discrimination and hostile educational environment claims against Northwestern.
