On April 8, 2025, a graduate of TNS filed this lawsuit in the U.S. District Court for the Southern District of New York against TNS. The plaintiff brought claims for hostile environment and disparate treatment under Title VI, New York Executive Law § 296, New York Civil Rights Law § 40, and N.Y.C. Administrative Code § 8-107, as well as breach of contract. The plaintiff sought damages, statutory penalties, and attorneys’ fees. This case was assigned to Judge Andrew L. Carter, Jr.

In the complaint, the plaintiff alleged that TNS violated Title VI by subjecting him to a hostile educational environment based on his perceived Jewish and/or Israeli identity and by acting with deliberate indifference to severe and pervasive antisemitic and anti-Israeli harassment. The plaintiff also claimed that TNS engaged in disparate treatment under Title VI by refusing to investigate his complaints while promptly pursuing retaliatory complaints against him arising from the same events. Additionally, the complaint asserted that TNS violated the New York State Human Rights Law, the New York Civil Rights Law, and the New York City Human Rights Law by permitting a hostile educational environment and engaging in disparate treatment. Finally, the complaint alleged breach of contract, asserting that TNS failed to enforce its nondiscrimination, anti-retaliation, and grievance policies, resulting in educational, emotional, and economic harm to the plaintiff.

On July 18, 2025, TNS filed a motion to dismiss. The plaintiff thereafter requested a pre-motion conference regarding an anticipated motion for leave to file an amended complaint. TNS opposed the request, arguing that the plaintiff had not previously sought leave to amend, that permitting amendment at this stage would be prejudicial, and that the proposed amended complaint failed to cure the deficiencies identified in TNS’s motion to dismiss and would therefore be futile.

Despite TNS’s objections, the court granted the plaintiff’s motion to amend the complaint and declared TNS’s motion to dismiss moot. On September 8, 2025, the plaintiff filed an amended complaint. This revised complaint added four new retaliation claims under Title VI, New York Executive Law § 296, New York Civil Rights Law § 40, and N.Y.C. Administrative Code § 8-107. It also incorporated extensive new factual allegations supporting the claim that TNS staff had actual notice of harassment based on the plaintiff’s perceived Jewish identity and expanded details regarding ongoing harassment incidents.

On October 10, 2025, the defendants filed a motion to dismiss the amended complaint. TNS contended that the Title VI claims failed because the plaintiff was not Jewish and therefore could not plausibly allege intentional discrimination based on national origin, nor deliberate indifference or severe and pervasive harassment. TNS also argued that the disparate treatment and retaliation claims failed because the plaintiff did not allege discriminatory intent, protected activity, an adverse action, or a causal connection. Finally, TNS asserted that the state law claims failed for the same reasons, no enforceable contract was breached, and that the amended complaint was a violation of Rule 8.

This case is ongoing.
