This case was filed to determine which federal employees would have their status changed from career civil service to political appointee, making it easier for the Administration to fire them, after President Trump issued Executive Order 14003. This EO is President Trump's effort to implement his "Schedule F" plan for the civil service that he previously tried to accomplish in his first administration by issuing EO 13857, which was rendered moot when President Biden withdrew it.
On November 14, 2025, the National Treasury Employees Union (NTEU) - a union representing about 160,000 federal employees - filed suit in the U.S. District Court for the District of Columbia against the United States Office of Personnel Management (OPM). Filing under FOIA, Plaintiffs sought the release of records responsive to an August 2025 FOIA request filed to evaluate petitions that certain federal agencies have submitted to OPM as required by Executive Order 13957. These petitions contain the federal agency's plans for which employees would be changed from career civil service to political appointees. NTEU filed suit under FOIA because OPM failed to respond to NTEU's FOIA request within the 20 working day deadline.
This case was assigned to U.S. District Judge John D. Bates.
This case is ongoing.
