On October 10, 2025, Graduate Workers for Palestine (a collective of graduate students at Northwestern committed to standing up for the Palestinian people) and two Northwestern doctoral students filed this lawsuit in the U.S. District Court for the Northern District of Illinois against Northwestern University. The plaintiffs asserted claims alleging race discrimination and retaliation in violation of 42 U.S.C. § 1981 and Title VI of the Civil Rights Act of 1964, as well as violations of the Illinois Worker Freedom of Speech Act, 820 ILCS 57 (“IWFSA”).

In particular, the plaintiffs alleged that Northwestern violated 42 U.S.C. § 1981 and Title VI by intentionally discriminating against Palestinian, Arab, and anti-Zionist Jewish students through mandatory antisemitism training and related requirements that they claimed restricted advocacy for Palestinian rights and denied them equal educational benefits. They also asserted retaliation claims under both statutes, alleging that Northwestern imposed registration holds and threatened loss of student status in response to their opposition to these policies. Finally, they alleged that Northwestern violated the IWFSA by coercing student employees to complete the training under threat of losing their student status and employment, causing professional and emotional harm.

The plaintiffs sought a declaratory judgment, injunctive relief barring Defendant from using the IHRA definition and Antisemitism Here/Now training, and removing discipline from Plaintiffs’ records stemming from those policies, damages, and attorneys’ fees. The case was assigned to Judge Georgia N. Alexakis.

On November 19, 2025, Northwestern filed a motion to dismiss for failure to state a claim and lack of subject matter jurisdiction. Northwestern asserted that the challenged anti-bias training applied to all students regardless of race and national origin, so the plaintiffs failed to allege intentional discrimination or retaliation as required by federal civil rights laws. Northwestern further asserted that the IWFSA claim failed because the training was designed for students rather than employees and fell within statutory exceptions meant for fostering a respectful campus environment. Finally, Northwestern asserted that the court lacked subject matter jurisdiction over the student organization due to insufficient allegations of standing.

On December 22, 2025, the plaintiffs and Northwestern filed a joint stipulation of voluntary dismissal without prejudice. It is unclear whether they settled or what the settlement terms might be. Accordingly, the court dismissed this matter without prejudice on December 23, 2025.

This case is now closed.
