This case is an attempt by the United States to compel the State of Colorado to furnish an unredacted copy of its statewide electronic voter registration list. 

On December 11, 2025, The United States brought this lawsuit against Colorado Secretary of State Jena Griswold in U.S. District Court for the District of Colorado alleging violations of the Civil Rights Act of 1960 in light of Griswold's failure to furnish specific election records pursuant to 52 U.S.C. § 20703. The case was assigned to Chief Judge Philip A. Brimmer and referred to Magistrate Judge Cyrus Y. Chung for non-dispositive matters. Plaintiff claimed authority to request the records under both the National Voter Registration Act (NVRA), which requires states to make a reasonable effort to remove ineligible voters from the official list of eligible voters and to maintain records concerning the implementation of this requirement, and the Help America Vote Act (HAVA), which requires States to maintain and preserve certain records and papers that fall within the scope of Section 301 of Title III of the CRA. 

The plaintiff’s complaint alleges that the U.S. Attorney General received a complaint that Secretary Griswold’s office was failing to comply with its voter registration maintenance duties. The Attorney General requested a copy of all relevant records and that Colorado provide all relevant statutes, policies, and guidance setting out procedures to implement the requirements of 52 U.S.C. § 20701, but Griswold did not respond to the initial request, and later stated that she would not be producing any unredacted voter files. In its complaint, The United States requested that the Court declare Griswold’s refusal to provide the requested documents a violation of Title III of the Civil Rights Act, and order Griswold to provide the Attorney General the current, unredacted, electronic copy of Colorado’s computerized statewide voter registration list, including registrant’s full names, dates of birth, addresses, and drivers license or social security numbers. Along with its complaint, the plaintiff filed a motion to compel the defendant to produce these documents.  

On December 19, 2025, Magistrate Judge Cyrus Chung filed a notice indicating that due to a conflict of interest, he intended to recuse himself from this litigation unless the parties give consent to his continued involvement. Because the Court did not receive a waiver of disqualification from both parties, this case was reassigned to Magistrate Judge Timothy P O'Hara on December 30, 2025. 

This case remains in the early stages of litigation.
