Case Summary

[This summary is temporary while we research the case]. On May 3, 2023, several parents, on behalf of their minor children, filed this lawsuit in the District of Colorado against their children's school district. The plaintiffs alleged that the defendant introduced "concepts of gender fluidity and various types of sexual attraction" through its after-school club, the Genders and Sexualities Alliance (GSA). Moreover, the defendant allegedly encouraged children to keep GSA activities secret from parents and warned children about the trustworthiness of their parents. The plaintiffs alleged that this behavior violated their parental rights under the Fourteenth Amendment.

ORDER This matter is before the Court on 2 Motion to Proceed Anonymously (the "Motion"). The Motion requests leave for minor Plaintiffs to proceed using initials. Defendants do not oppose this request [see #14], and as a general rule, "minors are entitled to litigate anonymously." E.A. V. Gardner, 929 F.3d 922 (7th Cir. 2019). Accordingly, the Court GRANTS this request. The minor Plaintiffs will be referred to in this case by their initials. See Fed. R. Civ. P. 5.2(a)(3). The Motion also appears to request future leave to file unspecified documents under Level 1 restriction, pursuant to D.C.COLO.LCivR 7.2. The Court declines to grant restriction of hypothetical future-filed documents. To the extent that either party believes that specific documents filed in the matter should be subject to restriction, the Court will consider a request to restrict such documents in accordance with the procedures specified by D.C.COLO.LCivR 7.2 at that time. ORDER This matter is before the Court on 48 Motion to Restrict (the "Motion"). In the Motion, Stephanie Wood--a former attorney of record who has been terminated from this matter--seeks to restrict private contact information contained in the certificate of service of the earlier-filed 44 Motion to Withdraw. The Court agrees with Ms. Wood that her interest in privacy outweighs any interest that the public may have in accessing the private address of a terminated attorney of record, which holds no relevance to the proceedings before the Court. Accordingly, the Court GRANTS the Motion to the extent that it seeks Level 2 restriction of the Motion to Withdraw, and instructs the Clerk of Court to maintain 44 Motion to Withdraw under Level 2 restriction. A publicly viewable version of 44 Motion to Withdraw that redacts the contact information is available at [52-1]. The Court further notes that Ms. Wood's 52 Reply requests that an additional filing be placed under restriction. As Judge Wang has already explained: "All requests for the Court to take any action in this case must be made in a formal motion filed on the docket." [#50]. Pursuant to D.C.COLO.LCivR 7.1(d): "A motion shall not be included in a response or reply to the original motion." Moreover, to the extent that Ms. Wood's additional request is cognizable by the Court, such request has not been referred to this Court for ruling. [See #51] Accordingly, the Court declines to order any further restriction than that ordered above. SO ORDERED, by Magistrate Judge Scott T. Varholak on 9/20/2023. Pursuant to D.C.COLO.LCivR. 7.2(d), the Court will withhold ruling on Ms. Wood's Motion for three court business days. However, in order to prevent further unnecessary filings and strain on the resources of all involved, the Court notes that no further response from Defendants is required or expected. ORDER This matter is before the Court on 54 Second Motion for Leave to Restrict (the "Motion"), filed by Stephanie Wood. Ms. Wood seeks to restrict Dkt. No. 49 in order to prevent public disclosure of one sentence that relates to her private address. Ms. Wood has filed a publicly available version of Dkt. No. 49 that redacts the single sentence. [See #[54-2]]. Considering the public's ability to access the remainder of Dkt. No. 49, the Court determines that Ms. Wood's interest in privacy outweighs any interest that the public may have in accessing information related to her private address. [See # 53 ]. Accordingly, the Court GRANTS the Motion to the extent that it seeks Level 2 restriction of Dkt. No. 49, and instructs the Clerk of Court to maintain Dkt. No. 49 under Level 2 restriction. To the extent that the Motion seeks any further relief from the Court, such as a potential admonishment of Ms. Wood's former co-counsel, the Motion is DENIED. SO ORDERED, by Magistrate Judge Scott T. Varholak on 10/5/2023. Text Only Entry(stvlc4, ) (Entered: 10/05/2023)
