This is a lawsuit challenging and seeking to quash an administrative subpoena that the U.S. Department of Justice served on Children's Hospital Colorado, seeking information regarding gender affirming care.  

On August 8, 2025, Children's Hospital Colorado (the "Hospital") filed in the U.S. District Court for the District of Colorado a motion to quash in its entirety an administrative subpoena that the U.S. Department of Justice ("DOJ") served it on July 14, 2025.  The subpoena sought "vast quantities of information" related to gender-affirming care, including the identity and records of every patient that received puberty blockers or hormone treatments since 2020, hundreds of personnel files, and numerous internal and external communications. The Hospital provided such care to transgender youth pursuant to strict guidelines, in compliance with state law, and consistent with the recommendations of the American Medical Association and the American Academy of Pediatrics. The Hospital asserted that the subpoena was intended to further the objectives of two Trump Executive Orders that courts had already enjoined and found to be discriminatory.  It urged that, against that backdrop, the subpoena's true purpose was to intimidate and harass the Hospital into stopping provision of gender affirming care to transgender youth and to intimidate patients and providers, and that it should be quashed in its entirety because it lacked a proper purpose, was not properly authorized, and was over-broad and unduly burdensome. The matter was assigned to Judge S. Kato Crews and Magistrate Judge Cyrus Y. Chung. 

On January 5, 2026, Magistrate Judge Chung issued a recommended ruling that the Motion to Quash be granted. The Magistrate Judge reasoned that the government had failed to demonstrate that the requested information was reasonably relevant to the subpoena's congressionally authorized purpose. Judge Chung rejected the government's assertion that the subpoena was necessary to investigate offenses related to drug misbranding under the Federal Food, Drug, and Cosmetic Act (FDCA), noting that it hardly "even attempt(s) to explain the propriety of the Subpoena’s scope" nor "deigns to explain the government’s investigation, let alone how the Subpoena is right-sized for it."  Judge Chung reasoned that certain requests in the subpoena were not relevant to the asserted purpose. Moreover, Judge Chung explained that the subpoena abused the Court’s enforcement process, citing conclusions from other courts addressing similar subpoenas that their true purpose was to end gender-related treatment for minors and to gather as much information as possible about patients and practitioners. Judge Chung cited DOJ's behavior in the present matter as further evidence, noting that in response to the Hospital's requests to narrow the subpoena's scope, the government proposed changes that made clear that its focus was not on drug misbranding but rather on gender-affirming care, that its filings in the case had been conclusory and lacked any specifics about wrongdoing, and that its public statements about the investigation lacked any mention of the supposed FDCA wrongdoing and instead focused on ending gender affirming care for minors. Ultimately, the Magistrate Judge concluded that unless and until Congress enacted a statute justifying it, a purpose of investigating the legal activity of gender-affirming care could not support the subpoena and it must be quashed.  

On January 20, 2026, DOJ objected to and appealed Judge Chung's recommendation that the Motion to Quash be granted. The government's objection to the recommended ruling remains pending as of late March 2026.  

This case is ongoing.
