On January 29, 2026, President Donald Trump, Donald Trump Jr., Eric Trump, and The Trump Organization, LLC filed this lawsuit in the U.S. District Court for the Southern District of Florida against the Internal Revenue Service (IRS) and the U.S. Department of the Treasury. Represented by private counsel at BRITO, PLLC and Epstein & Co. LLC, the plaintiffs brought two counts: (1) unauthorized inspection and disclosure of tax return information in violation of 26 U.S.C. § 6103 and 26 U.S.C. § 7431(a)(1), and (2) violation of the Privacy Act, 5 U.S.C. § 552a(e)(10), for failure to safeguard their confidential tax return information. The plaintiffs sought at least $10 billion in compensatory damages, punitive damages, attorneys' fees, and costs, and demanded a jury trial. The case was assigned to District Judge Kathleen M. Williams, with Magistrate Judge Enjolique A. Lett handling discovery and pretrial matters.

The complaint alleged that from May 2019 through at least September 2020, Charles "Chaz" Littlejohn, a former IRS contractor employed through the consulting firm Booz Allen Hamilton, illegally accessed the plaintiffs' confidential tax returns and disclosed them to the New York Times and ProPublica. The plaintiffs alleged that the Treasury Inspector General for Tax Administration (TIGTA) had warned the IRS annually from 2010 through 2020 about security deficiencies, many of which went uncorrected. In October 2023, Littlejohn pleaded guilty to a violation of 26 U.S.C. § 7213(a) and was sentenced to five years in prison. The complaint cited the related case of Griffin v. IRS, No. 1:22-cv-24023 (S.D. Fla.), involving the same leak, which settled in June 2024 with the IRS issuing a formal apology. Griffin v. IRS, 730 F. Supp. 3d 1312 (S.D. Fla. 2024).

In February 2026, the court granted motions for leave to file amicus briefs by former government officials and public interest organizations and by Citizens for Responsibility and Ethics in Washington (CREW) and Public Citizen, after the plaintiffs filed no opposition. No defendant ever filed an appearance, answer, or responsive pleading.

On April 17, 2026, the plaintiffs filed a consent motion for a 90-day extension to allow for settlement discussions. Rather than ruling on the motion, on April 24, Judge Williams sua sponte raised concerns about Article III subject matter jurisdiction. She observed that although former President Trump claimed to sue in his personal capacity, the defendants were executive branch agencies subject to his direction while in office, and that Executive Order No. 14215 prohibited executive branch employees from advancing legal interpretations contrary to the president's positions. Judge Williams stayed the defendants' response obligation, ordered the parties to brief the jurisdictional question by May 20, and set a hearing for May 27. On April 29, she appointed attorneys from Debevoise & Plimpton LLP, Munger Tolles & Olson LLP, and Selendy Gay PLLC as amici curiae to assist the court on the issue. The court-appointed amici filed their memorandum on May 14, 2026.

On May 18, 2026, the plaintiffs filed a notice of voluntary dismissal with prejudice under Federal Rule of Civil Procedure 41(a)(1)(A)(i), which is self-executing in the Eleventh Circuit. 2026 WL 1382751. The notice made no reference to any settlement. That same day, the U.S. Department of Justice publicly announced a settlement agreement. Under its terms, the plaintiffs received a formal apology from the United States but no monetary payment. The settlement also resolved two separate Federal Tort Claims Act administrative claims by former President Trump related to the 2022 search of Mar-a-Lago and what the agreement described as the "Russia-collusion hoax." The agreement established a $1.776 billion "Anti-Weaponization Fund," funded from the Treasury Department's Judgment Fund, to compensate individuals alleging they were victims of government "Lawfare and Weaponization." The fund was to be administered by a five-member commission appointed by the Attorney General, with members removable by the president without cause. News reports indicated the settlement also included an addendum barring IRS examinations of the former president, his family, and his businesses.

On May 27, 2026, 35 former federal judges filed a motion under Federal Rule of Civil Procedure 60(d)(3), arguing the settlement was a product of collusion and itself a fraud on the court.  On May 29, Judge Williams reopened the case and ordered the plaintiffs to respond by June 12, addressing the charges of collusion, whether the dismissal was premised on deception, and whether the court was the victim of a fraud. 2026 WL 1506030; 2026 WL 1145973. Separately, on May 29, District Judge Leonie M. Brinkema in the U.S. District Court for the Eastern District of Virginia temporarily enjoined the government from disbursing money to the Anti-Weaponization Fund. On June 2, Acting Attorney General Todd Blanche stated in a congressional hearing that the administration would not go forward with the fund, and the DOJ subsequently confirmed in writing on June 5 that it would cease pursuing the fund. On June 12, Judge Brinkema issued a preliminary injunction in the Eastern District of Virginia case formalizing the bar on disbursements.

On June 12, 2026, the plaintiffs filed their response to the court's order. The plaintiffs argued that the Rule 41(a)(1)(A)(i) dismissal was self-executing and divested the court of jurisdiction the instant the notice was filed, leaving no judicial act that could have been corrupted by fraud. They contended that the former judges lacked standing to bring a Rule 60 challenge because their interests were not "directly affected" by the dismissal, as required under Eleventh Circuit precedent. The plaintiffs further argued that the Department of Justice possessed independent statutory authority under 28 U.S.C. §§ 2414, 2672, and 2677, and 31 U.S.C. § 1304 to settle claims administratively without judicial oversight, and that the settlement could have been reached regardless of whether the lawsuit was ever filed. On the merits, the plaintiffs maintained that their claims had independent legal merit, that three of the four plaintiffs were private citizens with no government role, and that the government's decision to settle rather than litigate available defenses was a rational litigation judgment rather than evidence of collusion. The plaintiffs warned that any order reopening the case or inquiring into the settlement would exceed the court's authority and warrant mandamus relief.

On June 19, 2026, the former judges filed their reply brief, arguing that the DOJ's unilateral abandonment of the Anti-Weaponization Fund was itself evidence that the parties were never truly adverse, and that the plaintiffs' response only underscored the need to investigate whether the parties perpetrated a fraud on the court. On June 22, 2026, a group of former IRS and DOJ officials filed an amicus brief arguing that the settlement's audit-immunity provision was unprecedented and unlawful and urging Judge Williams to scrutinize the agreement.

As of June 25, 2026, this case remained open before Judge Williams, with the fraud-on-the-court inquiry ongoing.

THIS MATTER is before the Court sua sponte. On February 5, 2026, former government officials and public interest organizations filed a Motion for Leave to File Brief as Amici Curiae ("First Motion") (DE 7 ).
