Order on Motion to Hold in Abeyance

MINUTE ORDER granting the plaintiff's 40 Motion to Hold Proceedings in Abeyance Pending Interlocutory Appeal. "The power to stay proceedings is incidental to the power inherent in every court to control the disposition of the causes on its docket with economy of time and effort for itself, for counsel, and for litigants." Air Line Pilots Ass'n v. Miller, 523 U.S. 866, 879 n.6 (1998) (citation modified). The decision whether to stay proceedings is thus an "exercise of judgment" that requires the Court to "weigh competing interests and maintain an even balance." Id. (citation modified).The Court concludes that a stay of proceedings pending resolution of the plaintiff's interlocutory appeal is warranted here. "Although courts should strive to decide cases alleging ongoing First Amendment violations expeditiously, here, it is the plaintiff that seeks to slow things down pending appeal." Ready to Win v. FEC, No. 22-cv-3282, 2023 WL 10512144, at *2 (D.D.C. July 28, 2023). Furthermore, the defendants have not identified any harm that they are likely to suffer from a delay. See id. Contrast, e.g., Landis v. N. Am. Co., 299 U.S. 248, 255 (1936) ("[T]he suppliant for a stay must make out a clear case of hardship or inequity in being required to go forward, if there is even a fair possibility that the stay for which he prays will work damage to some one else."). Finally, should the D.C. Circuit disagree with this Court's irreparable harm analysis, the interlocutory appeal is likely to resolve critical legal questions in this case. Compare, e.g., Wrenn v. District of Columbia, 179 F. Supp. 3d 135, 139 (D.D.C. 2016) (stay not appropriate where there was considerable uncertainty whether D.C. Circuit's resolution of interlocutory appeal would impact discovery proceedings before the district court), with Minute Order, Wrenn v. District of Columbia, No. 15-cv-162 (Jan. 17, 2017) ("[N]ow that the discovery period has concluded and the necessary records will be on hand, the Court finds it prudent to stay this matter until the Court receives a mandate from the D.C. Circuit, which will obviate the parties' need to potentially rebrief or supplement their motions for summary judgment in light of the D.C. Circuit's ruling."). Thus, "if this matter were permitted to proceed at this time, it seems likely that the parties would need to amend or supplement their pleadings, which inevitably would waste both the litigants' and the Court's resources." United States ex rel. Vt. Nat'l Tel. Co. v. Northstar Wireless, L.L.C., No. 15-cv-728, 2017 WL 11898169, at *3 (D.D.C. Mar. 2, 2017).Accordingly, it is ORDERED that proceedings before this Court are STAYED pending further order of this Court. It is further ORDERED that, within 14 days of the D.C. Circuit's issuance of a decision resolving the pending interlocutory appeal, the parties shall file a joint status report proposing a schedule to govern further proceedings.
