The alleged retaliation took two primary forms: Ferguson issued a sweeping Civil Investigative Demand (CID) requiring NewsGuard to produce virtually all documents since its 2018 founding, and he imposed a condition in the Omnicom-IPG merger approval that prohibits the merged company from using NewsGuard's services.

NewsGuard claimed these actions constituted unconstitutional retaliation for its First Amendment-protected journalistic activities. The complaint raised three causes of action: First Amendment violation for unconstitutional retaliation based on perceived viewpoints, First and Fourth Amendment violations for unjustified and overly burdensome CIDs, and First Amendment violation for unlawful targeting of NewsGuard's activities via intermediaries. NewsGuard sought declaratory relief, preliminary and permanent injunctive relief to stop enforcement of the CID and merger condition, attorneys' fees and costs, and demanded a jury trial. The case was assigned Judge Dabney L. Friedrich.

On February 11, 2026, plaintiffs filed a motion for a preliminary injunction.

On March 6, 2026, defendants sent notice to the court that they had issued a ruling denying plaintiff’s petition to quash the CID.
