Increased ICE enforcement and concerns about abuses of power led the first and second Plaintiff to create a social media group and an app, respectively, each dedicated to sharing information about ICE enforcement activities. The first Plaintiff created the “ICE Sightings – Chicagoland” Facebook group to allow fellow residents of Chicago to share information about ICE sightings. The second Plaintiff created the "Eyes Up" app to allow users to preserve and view videos of ICE activity across the country.

Together, Plaintiffs alleged that Defendants coerced Facebook to disable the Facebook group and coerced Apple to remove the Group’s Eyes Up app from its App Store, in violation of their First Amendment guarantees. Their complaint alleged that defendants wanted to control what the public can see, hear, or say about ICE operations.  Filing under the First Amendment, Plaintiffs sought attorneys' fees, a jury trial, and an injunction barring Defendants from coercing Facebook and Apple into suppressing the “ICE Sightings" Facebook group and "Eyes Up" app, respectively. 

The case was assigned to Judge Jorge L. Alonso on February 12, 2026, with the Honorable Maria Valdez presiding as Magistrate. The following week, on February 17, Judge Alonso set a schedule regarding telephonic hearings and status reports, with parties asked to submit a joint status report by May 11, 2026.
