This case challenges the Trump Administration’s alleged coercion of Facebook and Apple to remove groups and apps that allowed users to share information regarding U.S. Immigration and Customs Enforcement (ICE) activity. On February 11, 2026, Plaintiffs filed this lawsuit against then-U.S. Attorney General, Pamela Bondi, and then-Secretary of Homeland Security, Kristi Noem, in U.S. District Court for the Northern District of Illinois. Increased ICE enforcement and concerns about abuses of power led the first and second Plaintiff to create a social media group and an app, respectively, each dedicated to sharing information about ICE enforcement activities. The first Plaintiff created the “ICE Sightings – Chicagoland” Facebook group to allow fellow residents of Chicago to share information about ICE sightings. The second Plaintiff created the "Eyes Up" app to allow users to preserve and view videos of ICE activity across the country. Together, Plaintiffs alleged that Defendants coerced Facebook to disable the Facebook group and coerced Apple to remove the Group’s Eyes Up app from its App Store, in violation of their First Amendment guarantees. Their complaint alleged that Defendants wanted to control what the public can see, hear, or say about ICE operations.  Bringing a claim for violation of the First Amendment, Plaintiffs sought attorneys' fees, a jury trial, and an injunction barring Defendants from coercing Facebook and Apple into suppressing the “ICE Sightings" Facebook group and "Eyes Up" app, respectively. 

The case was assigned to District Judge Jorge L. Alonso on February 12, 2026, with the Honorable Maria Valdez presiding as Magistrate. On February 26, 2026, Plaintiffs filed a motion for preliminary injunction seeking to enjoin Defendants from their alleged activities. The court granted Plaintiffs’ motion for preliminary injunction on April 17, 2026. The court reasoned that Plaintiffs were likely to succeed on the merits of their claims because the Defendants violated their First Amendment rights when they demanded removal of the group and app and intimated that Facebook and Apple may be subject to prosecution for failing to comply. 2026 WL 1047786.

On June 9, 2026, Defendants filed a motion to dismiss for lack of jurisdiction and failure to state a claim. 

This case is ongoing.
