This case challenges the terminations of federal formal employees on the grounds that improper procedure was used in their firings. 

On February 13, 2026, former federal employees filed this lawsuit in the U.S. District Court for the District of Maryland against multiple federal agencies and officials, challenging their terminations through purported reductions in force (“RIFs”).  The complaint asserted causes of action under the Fifth Amendment Due Process Clause, the Administrative Procedure Act (APA), and the Privacy Act, alleging that defendants unlawfully manipulated RIF procedures, denied meaningful pre- and post-deprivation process, and relied on inaccurate personnel records to effectuate terminations. The plaintiffs further alleged that the Administration compromised the independence and functionality of the Merit Systems Protection Board (MSPB), rendering the statutory appeal process futile and constitutionally inadequate. They sought declaratory and injunctive relief restoring them to their positions and damages under the Privacy Act. This case was assigned to District Judge Stephanie A. Gallagher. 

On April 24, 2026, the plaintiffs moved for a preliminary injunction seeking reinstatement of their positions during the pendency of this litigation and to enjoin the defendants from retaliating against them. The plaintiffs maintained that they were likely to succeed on the merits of their Fifth Amendment Due Process claim because the defendants did not provide them with adequate notice nor an opportunity to be heard prior to their termination. They further argued that they would likely succeed on their APA claim because their removals were contrary to the established statutory and regulatory RIF requirements. The defendants responded on June 3, 2026, arguing that the Civil Service Reform Act (CSRA) prevented the district court from having jurisdiction over the plaintiffs’ claims, and that the plaintiffs were unlikely to succeed on the merits. 

The defendants moved to dismiss the case on June 12, 2026 arguing that the CSRA precluded the district court’s jurisdiction. They also contended that the plaintiffs failed to state a claim against MSPB because the employment decisions that the plaintiffs based their claims upon were made by the plaintiffs’ employing agencies, not MSPB, and thus the claims against it should be dismissed. Additionally, the defendants asserted that the Declaratory Judgment Act claim should be dismissed because that did not create a stand alone cause of action. 

On July 20, 2026, the court held a hearing on the plaintiffs’ motion for a preliminary injunction. On July 27, 2026, the court denied the motion, declining to reinstate the plaintiffs’ positions during litigation. The court held that the plaintiffs failed to meet their burden of demonstrating that their right to relief was “indisputably clear”. The court explained that there were substantial unresolved jurisdictional questions about whether the court could hear the claims before it, and at the early stages of this case, it would be difficult to disentangle these questions with questions on the merits. Specifically, the court found that there were some factors that weighed more in favor of the plaintiffs, particularly as it related to constitutional issues of agency independence, and others that weighed more in favor of the defendants, including allegations that are typically presented to the MSPB.
