President Trump promulgated EO 14203 on February 6, 2025, under the putative authority of the International Emergency Economic Powers Act. EO 14203 purports to address the threat that the International Criminal Court (“ICC”) may pursue certain “protected persons” (i.e., nationals of the United States and non-consenting allies), and it sanctions foreign persons deemed to have “directly engaged in” or assisted the ICC’s pursuit of such “protected persons.” The order targets individuals involved in investigating or prosecuting U.S. personnel or allies, notably in response to ICC actions concerning the Israeli occupation of Gaza.

This complaint filed on February 25, 2026, in the United States District Court for the District of Columbia involves a constitutional challenge to EO 14203 brought by L.C., a minor U.S. citizen, through her father and guardian, an Italian citizen, along with her father and guardian himself. The defendants include President Donald J. Trump, Attorney General Pamela Bondi, Treasury Secretary Scott Bessent, and Secretary of State Marco Rubio. The case centers on the designation of the father and guardian's spouse, and L.C.'s stepmother, as a Specially Designated National (SDN) under EO 14203. L.C.'s stepmother is an Italian citizen and UN Special Rapporteur on Palestinian human rights who was sanctioned allegedly for supporting International Criminal Court (ICC) investigations. According to the plaintiffs, she was sanctioned solely for exercising First Amendment rights through public statements endorsing ICC work regarding Israeli officials and American companies. The sanctions have reportedly blocked the family's co-owned property in Washington D.C., where L.C. was born, and severely disrupted their ability to travel, work, and maintain normal family relationships. The complaint asserts eight causes of action challenging EO 14203 on multiple constitutional and statutory grounds, including violations of the First, Fourth, and Fifth Amendments, as well as statutory violations under federal law. Plaintiffs seek comprehensive relief including declaratory judgments, removal from the SDN designation, injunctive relief against enforcement actions, and attorney's fees.

On the same day as filing the complaint, the plaintiffs filed a motion seeking a preliminary injunction to prevent the defendants from enforcing EO 14203.

The case was assigned to District Judge Richard J. Leon.

The court held a hearing regarding the preliminary injunction on April 1. As of April 21, 2026, the court has yet to issue its ruling on the matter.
