On March 9, 2026, Plaintiffs - a coalition of technology nonprofits - filed this lawsuit against Marco Rubio, Kristi Noem, and Pamela Bondi in their official capacities in U.S. District Court for the District of Columbia. Plaintiffs alleged that the Trump administration adopted what they termed a "Censorship Policy" that excludes and deports noncitizens whose work involves combatting misinformation and disinformation, fact-checking, content moderation, trust and safety, or compliance. Plaintiffs contended that this policy punishes expressive activity based on viewpoint and targets noncitizens for their research, advocacy, content moderation, or other work that supports greater moderation of content on internet platforms. The complaint alleged that on December 23, 2025, Defendant Rubio announced that the State Department would exclude or deport five specific individuals pursuant to this policy. Plaintiffs claimed this policy chilled the expressive and associational activities of their noncitizen members through fear of detention and deportation. Filing under the First Amendment, the Fifth Amendment, and the Administrative Procedure Act, Plaintiffs sought to enjoin defendants from further implementation of the censorship policy.

The case was assigned to Judge James E. Boasberg. On March 26, 2026, Plaintiffs filed a motion for both a preliminary injunction and a section 705 stay of the Censorship Policy.

This case is ongoing.
