On March 9, 2026, Anthropic filed this complaint in the U.S. District Court for the Northern District of California. District Judge Rita F. Lin was assigned to the case. Anthropic named numerous federal agencies and agency heads as defendants, including the Department of War and the Secretary of Defense. It alleged that the federal government had retaliated against the company for its public statements about the risks of providing the government with unrestricted use of its products. Anthropic alleged five counts: Administrative Procedure Act (APA) violations, First Amendment retaliation, ultra vires executive action, Fifth Amendment due process violations, and additional APA sanction violations, seeking declaratory and injunctive relief.

The dispute arose in the context of Anthropic's contracts with the federal government. U.S. intelligence and defense agencies had been using Anthropic's signature large language model (LLM) product, "Claude," since 2024. The Department of War's (DOW's) usage policy, contained in its contract, prohibited using Claude for mass surveillance of Americans and for lethal autonomous warfare. In fall 2025, the Department of War asked Anthropic to remove these restrictions from its usage policy and agree to a new contractual provision allowing the DOW, its contractors, and its subcontractors to use Claude “for all lawful uses.” Anthropic agreed to eliminate most of its usage restrictions, but refused to drop the restrictions on use for mass surveillance and lethal autonomous warfare, because it did not believe Claude was safe for either use. The parties attempted to negotiate the restrictions over several months. At a meeting on February 24, 2026, the Secretary of Defense told Anthropic's representatives that if Anthropic did not agree to "all lawful uses" of its products by February 27, 2026, DOW would immediately designate Anthropic a supply chain risk. Alternatively, the Secretary warned that DOW might invoke the Defense Production Act to designate Anthropic as essential to national security and thus compel Anthropic to provide its services without the restrictions.

On February 26, 2026, Anthropic's CEO issued a public statement concluding that the company could not, "in good conscience," provide DOW with the requested access. The next day, President Trump directed all federal agencies to immediately cease using Anthropic's technology. The Secretary of Defense simultaneously directed the DOW to designate Anthropic a "Supply-Chain Risk to National Security" and prohibited U.S. military contractors, suppliers, and business partners from conducting commercial activity with Anthropic. The Secretary also sent Anthropic a letter confirming the designation. As of September 2026, Anthropic remains the first and only American company to have received this designation.

On March 9, 2026, Anthropic filed this lawsuit, which challenged the designation and the effective bar that the government had created on Anthropic's contracting work. Anthropic also filed a motion for a temporary restraining order, arguing that the challenged actions punished the company for its speech and would irreparably harm it by damaging its reputation and business relationships.

On March 26, Judge Lin granted Anthropic a preliminary injunction. The Court found that the company had shown a high likelihood of success on its First Amendment retaliation claim and Fifth Amendment Due Process claim. The Court found that the defendants had failed to prove that Anthropic's conduct qualified as a supply-chain risk. However, Judge Lin stayed the order for seven days, allowing the defendants to appeal and seek an emergency stay from the Ninth Circuit.

On April 2, 2026, the defendants appealed the District Court's preliminary injunction order to the Ninth Circuit. Three weeks later, on April 22, they moved to stay proceedings pending the outcome of a related case in the D.C. Circuit, Anthropic PBC v. U.S. Department of War. The defendants argued that the two cases presented legally and factually overlapping issues, that expedited briefing was already underway in the D.C. Circuit, and that the court in that case had already scheduled oral argument. The Ninth Circuit granted the government's motion to stay, but required the defendants to file a motion for appropriate relief within 21 days after the resolution of the D.C. Circuit case.

Meanwhile, matters proceeded in the District Court. On June 10, 2026, Anthropic filed a motion for summary judgment on its First Amendment, APA, and Due Process claims, and separately moved to complete the administrative record and to consider evidence outside the administrative record in evaluating its APA claims. On June 24, 2026, defendants filed a cross-motion for summary judgment. A number of non-parties filed amicus briefs, including former federal officials, public interest organizations, and private companies.

The District Court held a hearing on the cross-motions for summary judgment on July 27, 2026. On August 27, 2026, the court granted Anthropic's motion for summary judgment on its First Amendment, Due Process, and APA claims, and also granted Anthropic's motion to consider evidence outside the administrative record, and considered the evidence in evaluating Anthropic's APA claims.

The court provided Anthropic's requested declaratory relief, and declared that the government's challenged actions violated the First Amendment, the Due Process Clause, and the APA. The court enjoined the government from implementing, enforcing, or giving effect to its directives. It vacated, set aside, and remanded Anthropic's "supply-chain" designation. It also vacated and set aside the portion of the Secretary of Defense's directive ordering all contractors, suppliers, and business partners of the U.S. military to stop conducting commercial activity with Anthropic, as well as actions taken by other agencies to implement the Presidential directive. The court denied the government's motion for a seven-day administrative stay of its final order.

The District Court closed the case on August 27, 2026. As of September 2026, D.C. Circuit case remains ongoing.
