The dispute arose after Anthropic refused to remove two usage restrictions from its Claude AI - prohibiting use for lethal autonomous warfare and mass surveillance of Americans - leading President Trump to direct all federal agencies to immediately cease using Anthropic's technology, and Secretary Hegseth to designate Anthropic a "Supply-Chain Risk to National Security." As of March 22, 2026, Anthropic remains the first and only American company to have received this designation. Anthropic alleged five counts: APA violations, First Amendment retaliation, ultra vires executive action, Fifth Amendment due process violations, and additional APA sanction violations, seeking declaratory and injunctive relief.

The same day they filed their complaint, Plaintiff moved for a Temporary Restraining Order, arguing that the challenged actions would inflict irreparable harm by punishing them for their speech and damaging both reputation and business relationships. The Foundation for Individual Rights and Expression, Electronic Frontier Foundation, Cato Institute, Chamber of Progress, First Amendment Lawyers Association moved to file amicus briefs, along with individual employees from Google and OpenAI in their personal capacities. The first of the organizational amicii filed their briefs on March 13th, with additional movants' briefs pending.

On March 26, Judge Lin granted Plaintiffs' Motion for Preliminary Injunction. The court found that Plaintiff had shown a high likelihood of success on their First Amendment retaliation claim, having made a prima facie case. It also found Plaintiffs likely to succeed on their Fifth Amendment Due Process claim. Most essentially, the court wrote that Defendants have as of yet failed to prove that Anthropic's conduct qualifies as a supply-chain risk. In the same order, Judge Lin granted Defendants’ request for an administrative stay for seven days to seek an emergency, expedited stay from the court of appeals.
