On March 9, 2026, the plaintiffs, two nonprofit advocacy organizations serving African immigrants and refugees, along with four anonymous individuals, filed this lawsuit in the U.S. District Court for the District of Massachusetts against the United States Department of Homeland Security (DHS) and Immigration and Customs Enforcement (ICE). The plaintiffs sought to challenge the elimination of Temporary Protected Status (TPS) for Somalis in Minnesota prior to the effective termination of said status on March 17. In their complaint, the plaintiffs argued that in deciding the termination of the TPS status, DHS bypassed mandatory procedures and ignored dire humanitarian conditions in Somalia to fulfill a preordained political agenda. The plaintiffs further alleged that the decision was fueled by discriminatory animus and racial targeting from the Trump Administration, which repeatedly disparaged the Somali community, and that this termination threatened to uproot thousands of people who have built deep community ties and careers within the United States. The plaintiffs argued that the termination decision violated the APA because it was contrary to law, in excess of statutory authority, and arbitrary and capricious, and that it violated the Fifth Amendment’s Equal Protection guarantee because the decision was motivated in part by a racially discriminatory intent or purpose. The plaintiffs sought declaratory and injunctive relief, requesting that the court stay and/or postpone the termination from taking effect.

This case was assigned to District Court Judge Allison D. Burroughs.

The same day they filed their complaint, on March 9, 2026, the plaintiffs filed an emergency motion to stay the implementation of Somalia’s TPS termination. On March 13, 2026, the court granted the motion in part. The court granted an administrative stay, which temporarily stopped the expiration from taking effect while the court reviewed the case. The court determined that a stay was necessary to allow for a full legal review and the production of government records before a final decision is reached, and to ensure that affected individuals remain protected from deportation and retain work authorization during the initial stages of litigation. The court deferred ruling on a postponement of the TPS termination, reasoning that postponing the effective date of a decision committed to the executive branch by Congress risks harmful interferences with the other branches of government. 2026 WL 710666. 

On April 24, 2026, the plaintiffs moved to compel discovery, and requested that the court order the defendants to provide unredacted information from records that they had produced. Specifically, they sought material pertaining to deliberative process privilege and law enforcement privilege. 

On April 29, 2026, the court ordered the parties to advise the court whether they opposed a stay of litigation pending the Supreme Court’s disposition of two consolidated cases pertaining to the TPS designations of Syria and Haiti, Noem v. Doe and Trump v. Miot. Because both parties indicated that they did not oppose staying the action, the court stayed the case on May 1. The court asked the parties to file a joint status report no more than fourteen days after the Supreme Court’s ruling.

On June 25, 2026, the Supreme Court issued its ruling in Noem and Miot, holding that federal courts are not permitted to review procedural challenges - those that are non-constitutional - to the government’s termination or designation of TPS. This decision vacated lower court injunctions that had blocked the termination of TPS for individuals from Haiti and Syria. 

As of July 1, 2026, the court awaits the parties’ status report in light of the Supreme Court’s decision.

Judge Allison D. Burroughs: ELECTRONIC ORDER entered. Both parties have indicated that they do not oppose staying this action until the Supreme Court has issued an opinion in Mullin v. Doe, No. 25-1083, and Trump v. Miot, No. 25-1084. See [ECF Nos. 71, 72 ]. Pursuant to the Court’s “inherent power to stay pending litigation when the efficacious management of court dockets reasonably requires such intervention,” Marquis v. F.D.I.C., 965 F.2d 1148, 1154 (1st Cir. 1992) (collecting cases), and in light of the fact that the question at issue in this case “will, in all likelihood, turn upon [the Supreme Court’s decision in a recently argued case],” Marshel v. AFW Fabric Corp., 552 F.2d 471, 472 (2d Cir. 1977) (per curiam), this action is STAYED until the Supreme Court has issued a decision in Doe and Miot. The Court further accepts Plaintiffs’ proposal, see [ECF No. 71 at 1], and ORDERS the parties to file a joint status report within fourteen days of the Supreme Court’s decision in those cases. Judge Allison D. Burroughs: ELECTRONIC ORDER entered. On March 13, 2026, the Court entered an administrative stay of the termination of Somalia’s TPS designation to provide time for the government to produce the administrative record and the parties to brief the issues presented in this action. [ECF No. 33 ]. On May 1, 2026, with the agreement of the parties, the Court stayed this litigation until the Supreme Court decided Mullin v. Doe, No. 25-1083, and Trump v. Miot, No. 25-1084. [ECF No. 73 ]. Those cases were decided last week. Mullin v. Doe, Nos. 25-1083, 25-1084, 2026 WL 1825840 (U.S. June 25, 2026). The Court previously ordered the parties to file a joint status report within 14 days of that decision, [ECF No. 73 ], but rather than a joint filing, the government has now moved to lift both the stay of this action and the administrative stay of the underlying TPS termination, [ECF No. 77 ], which Plaintiffs have indicated they will oppose, [id. at 6]. The motion is GRANTED IN PART and DENIED IN PART. The stay of this action is lifted, but the administrative stay will remain in place until further notice to permit the Court to resolve the issues presented by Plaintiffs’ emergency motion, [ECF No. 3 ]. As originally ordered, by July 9, the parties shall submit a joint status report stating their respective positions on which counts of the complaint, if any, remain viable in light of the Supreme Court’s decision in Mullin v. Doe, Nos. 25-1083, 25-1084, 2026 WL 1825840 (U.S. June 25, 2026), and on appropriate next steps in this action.Finally, Plaintiffs’ motion to compel, [ECF No. 65 ], remains unopposed by Defendants. By July 9, Defendants shall also (1) file, ex parte, unredacted copies of each of the disputed documents for the Court to review, and (2) file any opposition to the motion to compel.
