The U.S. Department of Homeland Security (DHS) brought a criminal complaint charging an individual for interfering with a Minneapolis-based DHS agent.  

On January 26, 2026, the U.S. filed this criminal complaint in the U.S. District Court for the District of Minnesota. The complaint was against an individual who was alleged to have assaulted or otherwise interfered with a Minneapolis-based DHS Security Officer in carrying out his duties. The case was first assigned to Magistrate Judge Dulce J. Foster. Also on January 26, 2026, Magistrate Judge Foster granted the government’s motion to seal. 

On February 2, 2026, Magistrate Judge Foster recused herself, and the case was reassigned to Magistrate Judge Shannon G. Elkins and Judge Katherine M. Menendez. 

On March 10, 2026, eleven former U.S. military judge advocate officers (JAGs) filed an unopposed motion to file an amicus brief. The amici wrote of their concern "that deploying JAGs to prosecute civilians in federal court in cases without a substantial military nexus erodes vital democratic norms, harms military readiness, and impermissibly inserts the military into civilian law enforcement’s core functions."

On June 5, 2026, Judge Menendez granted an unopposed motion to file an amicus brief by twenty-seven former JAGs. This amicus brief echoed similar concerns to that of the earlier amicus brief in March. 

On June 12, 2026, the defendant filed a motion to dismiss for outrageous government conduct and vindictive prosecution as well as a motion to dismiss for failure to state an offense. On June 18, 2026, the government also filed a motion to dismiss.

On July 6, 2026, Judge Menendez dismissed the case with prejudice. 


This case is now closed.
