This case challenges the Trump Administration’s antisemitism lawsuit against Harvard University that threatened to take away federal funding for violating Title VI of the Civil Rights Act. The defendant described the lawsuit as an alleged attempt to coerce the university with the government’s demands on the handling of issues including antisemitism and race in admissions.

On March 20, 2026, the U.S. government filed suit against Harvard University Fellows and President ("Harvard") in U.S. District Court for the District of Massachusetts. In its complaint, the U.S. alleged that Harvard failed to protect their Jewish and Israeli students by (1) remaining deliberately indifferent to hostility against these groups and (2) intentionally refusing to enforce their campus rules when victims were Jews or Israelis. Because Harvard accepts grants from the U.S., it is required to comply with Title VI of the Civil Rights Act of 1964 (Title VI). The U.S. alleged that Harvard violated Title VI by its repeated discrimination against Jewish and Israeli students. This action sought to compel Harvard to comply with Title VI and to recover billions of dollars of taxpayer subsidies awarded to the university while Harvard allegedly engaged in this discriminatory conduct. The plaintiff sought a declaration that Harvard has violated Title VI, an injunction against the alleged discrimination, permission to rescind the grants previously given to Harvard, permission to discontinue grants to Harvard, and the appointment of an independent outside monitor. This case was assigned to District Court Judge Richard G. Stearns.

On April 13, 2026, the defendant moved to designate this case as related to Presidents & Fellows of Harvard College v. U.S. Department of Health & Human Services, No. 25-cv-11048-ADB (D. Mass.) (“Harvard v. HHS”) and to accordingly have the case transferred to District  Court Judge Allison D. Burroughs. On April 24, 2026, Judge Stearns denied the motion to relate the cases.

On May 14, 2026, a former research scholar at Harvard moved for leave to file an amici curiae brief against the defendant. The next day, the court denied this motion, as the substance of the proposed amici brief was deemed not relevant to any legal issue raised in the case. On May 18, 2026, the same individuals moved to reconsider this order. On June 11, 2026, the court denied this motion.

On May 18, 2026, the defendant moved to dismiss the case for failure to state a claim, arguing that the complaint does not plausibly allege any ongoing or threatened noncompliance with Title VI.

On May 20, 2026, Professors of Law at Harvard, Benjamin Eidelson and Deborah Hellman, moved for leave to file an amicus brief, which was granted by the court and filed that day. 

On June 8, 2026, the plaintiffs filed an amended complaint against Harvard. The amended complaint expanded allegations of systemic discrimination that highlighted a shift toward federal enforcement of Title VI violations. Accordingly, the court denied the original motion to dismiss as moot. 

On June 30, 2026, the defendants again moved to dismiss for failure to state a claim based on the amended complaint. On August 13, 2026, the court granted Harvard’s motion to dismiss, stating that the government did not sufficiently plead an ongoing violation of Title VI, and that the incidents focused on in the amended complaint were “too isolated and episodic to support a plausible inference that any institutionalized noncompliance with Title VI persists at Harvard to this day.” The court then asserts that the “decision is limited to the specific circumstances presented…where there is no plausible allegation of noncompliance following statutory notice.”

The same day, the court, in accordance with the August 13, 2026 order, dismissed the action.
