This case concerns whether states are obligated to disclose their unredacted voter registration lists to the federal government. 

On February 26, 2026, the United States Department of Justice (DOJ) filed suit in the U.S. District Court for the District of Utah against Deidre M. Henderson in her official capacity as Lieutenant Governor and chief election officer of Utah to compel disclosure of the state’s voter registration list. Utah did not fulfill the request, citing privacy concerns. The DOJ claimed that Utah’s noncompliance violated the Civil Rights Act of 1960 (CRA), which requires states to produce election records upon written demand by the attorney general. The DOJ demanded the voter registration list to determine defendant’s compliance with the Help America Vote Act (HAVA) and the National Voter Registration Act (NVRA). HAVA requires states to obtain and verify identifying information from voters before processing voter registration applications, and the NVRA requires states to take reasonable steps to remove the names of ineligible voters from official lists of eligible voters. The complaint further stated that Title III of the CRA is a special statutory proceeding because it facilitates pre-lawsuit investigation. Therefore, the DOJ contended that courts may not judge the adequacy of the basis or purpose of the government’s demand; they must only determine whether the demand was met. The DOJ sought a declaratory judgment stating that defendant’s refusal violated Title III of the CRA and injunctive relief ordering defendant to provide the federal government with the statewide voter registration list, along with any other election records required to ascertain Utah’s compliance with the HAVA and the NVRA. This case was assigned to District Judge David Barlow.

On March 13, 2026, Utah filed a motion to dismiss, noting that states have sole power to prescribe rules regulating federal elections and that the CRA does not require states to disclose voter registration information. Even if it did require disclosure, Utah argued that the government failed to state a sufficient basis or purpose for its demand as required by the CRA. Utah also cited privacy concerns and noted that, of the 29 similar lawsuits initiated by the DOJ, the three that proceeded to a decision at the motion-to-dismiss stage were, in fact, dismissed. On March 23, 2026, and April 7, 2026, Judge Barlow granted motions to intervene as defendants from the National Association for the Advancement of Colored People (NAACP) and the League of Women Voters of Utah (LWV), respectively. Both groups filed motions to dismiss as well. On May 20, 2026, the DOJ responded to the motion to dismiss, arguing for an interpretation of the CRA that would include voter registration lists and reiterating its argument that the factual basis for the demand is not open to judicial review. Regardless, the DOJ argued that it offered a proper basis and purpose for the demand because there was evidence suggesting that Utah was not in compliance with HAVA. The DOJ also noted that federal law overrides any state privacy laws. On June 3, 2026, the NAACP and LWV filed replies to the DOJ’s response.
