This civil case challenged alleged blockading of access to a Planned Parenthood facility in Florida by five anti-abortion activists.

On January 27, 2022, five defendants allegedly engaged in unlawful trespassing at the Fort Myers Health Center operated by Planned Parenthood in Fort Myers, Florida. The United States alleges that Calvin Zastrow, Eva Zastrow, and Katelyn Sims blocked the front door of the facility, with Eva Zastrow attempting to shove the door closed when a patient tried to enter while Calvin Zastrow and Katelyn Sims sat in front of the door. Kenneth Scott and Chester Gallagher allegedly attempted to enter through a back door and shoved signs under it when they couldn't open it. The alleged conduct resulted in a temporary halt of operations for at least one hour, caused patient appointments to be rescheduled or cancelled, and led to one employee quitting after eight years of employment. On June 20, 2024, the United States filed this civil action in the U.S. District Court for the Middle District of Florida under the Freedom of Access to Clinic Entrances Act (FACE Act), seeking civil penalties of up to $30,868 per violation, $5,000 in damages for each aggrieved person, and injunctive relief to prevent future violations. The defendants were all previously found guilty of trespassing prior to filing of this civil suit. Several of the defendants had been found guilty for similar behavior at other Planned Parenthood branches across the country.

The case was assigned to District Judge John L. Badalamenti.

On August 14, 2024, the defendants moved to dismiss the suit for failure to state a claim. Defendant Scott filed, pro se, a motion for discovery with the court, which the court later denied directing Scott to consult with the local discovery rules. On September 5, Scott filed a motion for an evidentiary hearing, which the court similarly denied.

On September 24, 2024, defendant Scott then filed, pro se, a counterclaim against the United States, claiming that the prosecutor was engaging in selective prosecution due to the defendants' pro-life ideology. Scott described a previous encounter in May 2022 where he and fellow gatherers got into an argument with a woman while holding up pro-life signs near the Fort Myers Planned Parenthood. He alleged that this woman almost hit them with her car and struck one of them in the face. Scott expressed outrage that the prosecutor's office chose not to pursue charging the woman. Throughout the filing, Scott repeatedly requested that Judge Badalamenti recuse himself from the case after Judge Badalamenti had denied discovery motions Scott filed, as they were not in compliance with the local discovery rules.

After taking office in January 2025, President Trump pardoned several of the defendants for their criminal convictions arising from their conduct at other Planned Parenthood facilities across the country.

After several status conferences were held, the parties filed a joint motion on January 27, 2025, to dismiss the suit with prejudice. The court officially dismissed all of the claims on February 4, 2025.

TEXT ORDER. The parties have filed a Joint Stipulation of Dismissal with Prejudice (Doc. 65) under Federal Rule of Civil Procedure 41(a)(1)(A)(ii) and 41(a)(1)(A)(i). The Stipulation is self-executing only as to Defendants Calvin Zastrow, Chester Gallagher, Eva Zastrow, and Katelyn Sims (aka Katelyn Velasco), under Rule 41(a)(1)(A)(i). See Fed. R. Civ. P. 41(a)(1)(A)(i); see also Matthews v. Gaither, 902 F.2d 877, 880 (11th Cir. 1990) (per curiam). As to the Rule 41(a)(1)(A)(ii) Stipulation between the United States and Kenneth Scott, the Stipulation fails to comply with Rule 41 because Katelyn Sims (aka Katelyn Velasco) is not a signatory to the Stipulation. See City of Jacksonville v. Jacksonville Hospitality Holdings, L.P., 82 F.4th 1031 (11th Cir. 2023); see also Fed. R. Civ. P. 41(a)(1)(A)(ii). Accordingly, the Clerk of Court is DIRECTED to terminate Defendants Calvin Zastrow, Chester Gallagher, Eva Zastrow, and Katelyn Sims (aka Katelyn Velasco). The claims against Kenneth Scott, and his counterclaims, remain because the United States and Kenneth Scott failed to have all parties sign the stipulation under Rule 41(a)(1)(A)(ii).
