On April 2, 2026, three civil rights and advocacy organizations – the League of United Latin American Citizens (LULAC), Secure Families Initiative (SFI), and Arizona Students' Association (ASA) – filed this lawsuit in the U.S. District Court for the District of Columbia. The plaintiffs sued multiple federal agencies and officials, all named in their official capacities, alleging that President Trump's Executive Order 14399 “Ensuring Citizenship Verification and Integrity in Federal Elections” represented an unconstitutional attempt to exercise powers over election administration that belonged to Congress and the states. The Order directed the creation of three citizen verification lists and mandated the United States Postal Service (USPS) to refuse delivery of mail-in or absentee ballots to individuals not enrolled on those lists. The plaintiffs claimed violations of the separation of powers, Administrative Procedure Act (APA), and the Privacy Act, seeking declaratory and injunctive relief to block implementation of the Order, along with attorney’s fees. The case was assigned to District Judge Carl J. Nichols. 

On April 10, 2026, the court consolidated this case with DSCC v. Trump (Case Number 26-cv-01114) and National Association for the Advancement of Colored People v. Trump (Case Number 26-cv-01151).

On April 20, 2026, multiple states filed a joint motion to intervene as defendants.
