This case was brought by the partner of a Capitol Police Officer who died as a result of the injuries he suffered defending the Capitol during the January 6 insurrection. This case was brought by the partner of a Capitol Police Officer who died as a result of the injuries he suffered defending the Capitol during the January 6 insurrection. It is part of a Clearinghouse Special Collection on January 6 (2021) civil cases.  

On January 5, 2023, the personal representative of deceased Capitol Police Officer Brian Sicknick sued President Donald Trump in his personal capacity along with January 6 rioters Julian Khater and George Tanios in the U.S. District Court for the District of Columbia. During the attack on the capitol, defendant Khater sprayed Officer Sicknick in the face with bear spray provided by defendant Tanios from less than eight feet away. Officer Sicknick was rushed to the hospital late on January 6, but passed away the next day at least in part due to the injuries he suffered defending the capitol. Plaintiff alleged wrongful death, rioting or inciting to riot and conspiracy to violate civil rights against all defendants, brought a common law assault claim against defendants Khater and Tanios, and brought an aiding and abetting common law assault claim against Donald Trump. This case was assigned to U.S. District Judge Amit Mehta.

On April 3, 2023, Donald Trump filed a motion to dismiss. Trump argued that his status as President granted him absolute immunity from civil liability for actions within his official duties, and thus plaintiff's claims were barred. Plaintiff filed her response on April 25, 2023, pointing out that in Thompson v. Trump, 590 F.Supp.3d, the U.S. District Court for the District of Columbia held that his status as President did not grant him absolute immunity. 

On May 10, 2023, defendant Tanios filed a motion to dismiss. This motion argued that plaintiff failed to put forth a legally cognizable claim because she is not a beneficiary of Officer Sicknick's estate, and did not allege that any beneficiary was harmed by Tanios' actions. 

On May 31, 2023, plaintiff filed a motion to file an amended complaint. Plaintiff updated the complaint to explain that she was named in Officer Sicknick's last will and testament as his domestic partner and thus was directly harmed by his death. Plaintiff also added a charge of survivor's action against all defendants, removed the assault and aiding and abetting charges, and added a negligence per se allegation against Khater and Tanios. Judge Mehta granted plaintiff's motion on October 18, 2023. 2023 WL 10669679.

On June 8, 2023, defendant Khater filed a motion to dismiss plaintiff's amended complaint. Khater alleged that plaintiff relied on generalized depictions of Trump supporters, rather than specifying actual allegations against defendant Khater. 

On August 14, 2023, President Trump filed a motion to stay the proceedings as they related to him for the duration of the criminal case United States v. Donald J. Trump, No. 1:23-cr-00257. Judge Mehta denied President Trump's motion for an indefinite stay on October 18, 2023. 

President Trump and defendant Tanios filed separate motions to dismiss plaintiff's amended complaint on November 2, 2023, alleging similar deficiencies to the first complaint. 

On January 2, 2024, Judge Mehta granted in part and denied in part all three defendant's motions to dismiss. Judge Mehta dismissed the wrongful death and negligence per se claims, but allowed the survival act claim to go forward. 709 F.Supp.3d 1.

On March 5, 2024, this case was partially consolidated with seven other civil cases against President Trump for his actions on January 6. For further updates in the civil action against President Trump, see Lee v. Trump on the Clearinghouse.

On February 3, 2025, plaintiff voluntarily stipulated to the dismissal with prejudice of all claims against defendant Khater. On March 3, 2025, plaintiff did the same for defendant Tanios.

MINUTE ORDER denying without prejudice Defendant President Donald J. Trump's 45 Motion to Stay. Defendant Trump's request for an "indefinite" stay, Def.'s Mot. at 12, is unwarranted at this time. This case remains at the motion-to-dismiss stage. The claimed dilemma posed by simultaneously defending himself in this case and his criminal case only will arise, if at all, during the discovery phase. His request is therefore premature. Further, the balance of interests, including Plaintiff's and the public's in moving this matter forward, do not favor a stay.
