This case was filed by two capitol police officers against Donald Trump in his personal capacity for damages stemming from his actions during the January 6 insurrection. This case was filed by two capitol police officers against Donald Trump in his personal capacity for damages stemming from his actions during the January 6 insurrection. This case is part of a Clearinghouse Special Collection on January 6 (2021) civil cases.

Plaintiffs Officer Blassingame and Officer Hemby defended the capitol during the January 6 Insurrection. Seeking compensatory and punitive damages, they filed suit against defendant Trump on March 30, 2021, in the U.S. District Court for the District of Columbia. During the January 6 riot, President Trump encouraged the rioters and delayed before tweeting that they should stop attacking the capitol - and sent only a begrudging message that also complimented the rioters. For his actions on January 6, plaintiffs alleged that defendant Trump directed assault and battery, aided and abetted assault and battery, directed intentional infliction of emotional distress, and was per se liable for inciting to riot and disorderly conduct. This case was assigned to U.S. District Judge Amit Mehta. 

On April 28, 2021, Plaintiffs amended their complaint to allege that President Trump also conspired in violation of 42 U.S.C. § 1985 and committed civil conspiracy. 

On June 24, 2021, defendant Trump filed a motion to dismiss for lack of jurisdiction. Trump argued that he was absolutely immune from civil liability for actions undertaken during his presidency. Plaintiffs filed their response brief on July 22, 2021, arguing that President Trump was not immune from civil liability during his presidency.

On August 4, 2021, Judge Mehta granted Trump's motion to file a consolidated reply to plaintiffs in this case along with similar actions Thompson v. Trump and Swalwell v. Trump. President Trump was sued in each case for his actions on January 6, and raised the same presidential immunity defense in each case.

On February 18, 2022, Judge Mehta granted in part and denied in part Trump's motion to dismiss. Judge Mehta dismissed the intentional infliction of emotional distress claim, the civil conspiracy claim, and the punitive damages claim. However, Judge Mehta denied Trump's motion for the § 1985 claim, the directing/aiding and abetting assault claim, and the negligence per se claims. Judge Mehta also denied Trump's defense of absolute immunity for actions undertaken during his presidency. 

On March 21, 2022, President Trump appealed Judge Mehta's denial of his absolute immunity defense to the U.S. Court of Appeals for the D.C. Circuit. The D.C. Circuit denied President Trump's appeal on March 23, 2023.

On February 16, 2024, the D.C. Circuit remanded the case. The Court ordered that, if Defendant Donald J. Trump wishes to have the "opportunity to dispute the plaintiffs' allegations bearing on the immunity question or to introduce his own facts pertaining to the issue," he "must be afforded an opportunity to resolve this immunity claim before merits discovery." Blassingame v. Trump, 87 F.4th 1, 29 (D.C. Cir. 2023). 

Also on February 16, 2024, this case was consolidated with Lee v. Trump and six other cases, all filed by civil plaintiffs suing President Trump over his actions on January 6.

ORDER. These matters have returned to this court following a remand from the D.C. Circuit. The D.C. Circuit has ordered that, if Defendant Donald J. Trump wishes to have the "opportunity to dispute the plaintiffs' allegations bearing on the immunity question or to introduce his own facts pertaining to the issue," he "must be afforded an opportunity to resolve this immunity claim before merits discovery." Blassingame v. Trump, 87 F.4th 1, 29 (D.C. Cir. 2023). That opportunity could include "discovery bearing on the immunity question." Id. To discuss further proceedings in these cases, the parties shall appear for a status conference on February 23, 2024, at 1:30 p.m. in Courtroom 10. A public line shall be connected for this proceeding. The parties shall file a Joint Status Report on or before February 22, 2024, which addresses (1) whether Defendant should file answers at this time; (2) whether the parties wish to pursue discovery as to the immunity question before merits discovery; (3) assuming the parties will first seek immunity-related discovery, the expected parameters of such discovery; (4) a timeline for immunity-related discovery; and (5) any anticipated complex discovery issues that are likely to arise in this matter. In addition, the court sua sponte consolidates these matters for purposes of immunity-related discovery, resolution of the immunity issue on summary judgment, and merits discovery, if necessary. Unless ordered otherwise, all future filings in these matters shall be in the first-filed case, Thompson v. Trump, Case No. 21-cv-00400 (APM). See attached Order for additional details.
