This is a civil action brought by the District of Columbia against Proud Boys and Oath Keepers who stormed the capitol on January 6. This is part of a Clearinghouse Special Collection on January 6 (2021) civil cases. 

On December 14, 2021, the District of Columbia brought suit in U.S. District Court for the District of District of Columbia against 37 individual members of the Proud Boys and Oath Keepers who participated in the January 6 insurrection, as well as the Proud Boys and Oath Keepers as organizations. Seeking declaratory, injunctive, and monetary relief, plaintiff alleged that the defendants committed multiple torts when they violently stormed the capitol, including 42 U.S.C. § 1985(1), 42 U.S.C. § 1986, civil conspiracy, intentional infliction of emotional distress, assault, and battery. This case was assigned to U.S. District Judge Amit Mehta. 

Notable Proud Boy Defendants

Notable Oath Keeper Defendants

On March 11, 2022, defendants Steele, Meggs, and Keuhen filed separate motions to dismiss. Each defendant alleged that Plaintiff, as a city, lacked standing to bring common law tort claims against defendants.

On April 1, 2022, plaintiff filed an amended complaint naming additional defendants, notably including Oath Keeper leader Elmer Rhodes. Each new defendant had admitted wrongdoing on January 6 as part of their separate criminal proceedings. 

On June 17, 2022, multiple defendants filed motions to dismiss the amended complaint, again alleging that plaintiff lacked standing to bring common law tort actions. Also on June 17, defendant Klein filed a motion to stay the proceedings pending the resolution of his criminal case for his alleged crimes on January 6 - which included injuring a Capitol Police Officer. 

On September 30, 2022, Judge Mehta stayed the case pending the trial in United States v. Rhodes due to the overlapping defendants in that case and this one. 

On March 31, 2023, Judge Mehta granted in part and denied in part defendants motion to dismiss. He dismissed the 42 U.S.C. § 1985(1) and 42 U.S.C. § 1986 claims. Judge Mehta also dismissed the plaintiff's request for permanent injunctive relief because many of the defendants are incarcerated and none of them have engaged in political violence in more than two years since the January 6 attack. So, plaintiffs' concern about similar future violence by these defendants was too conjectural to grant permanent injunctive relief. 2023 WL 2733767.

On April 6, 2023, Judge Mehta ordered that discovery be consolidated with Smith v. Trump, a similar January 6 civil case brought against many of the same plaintiffs. 

On October 5, 2023, Judge Mehta entered a default judgment against Defendants Ryan Ashlock, Marc Anthony Bru, William Chrestman, Donovan Rayn Crowl, Charles Donohe, Josephe Hackett, Arthur Jackman, Joshua James, Ethan Nordean, Nicholas Robert Ochs, Daniel Lyons Scott, the Oath Keepers, and the Proud Boys because none of the above individuals or entities participated in the litigation. 

On July 19, 2024, plaintiff filed a motion for partial summary judgement. Plaintiffs argued they should receive partial summary judgment on the first two elements of the Smith Plaintiffs' § 1985 claims based on collateral estoppel. Further, partial summary judgment should be granted on plaintiff's civil conspiracy claims and other tort claims against defendants Donohoe and Pezzola, both of whom had been convicted of crimes on January 6. Defendants filed their response on August 21, 2024.

On February 28, 2025, plaintiffs moved to dismiss the case with prejudice with respect to all defendants pursuant to Federal Rule of Civil Procedure 41(a)(2). Plaintiff noted that the D.C. Attorney General "has determined that, notwithstanding the virtue and propriety of this case, the District's limited law enforcement resources must now be committed elsewhere  in the service of the District residents, taking into account both the growing challenges the District faces and the relatively small recoveries the District stands to obtain."

Judge Mehta dismissed the case with prejudice on March 14, 2025. 2025 WL 823904.
