This case concerns a challenge to a Nevada parental notification law that, after being enjoined for forty years, was brought into effect after Dobbs. The notification law was also challenged in state court. Planned Parenthood Mar Monte, Inc. v. Nevada.

In 1985, the Nevada legislature passed Senate Bill 510 (NRS 442.255 and NRS 442.2555), which prevented that an unmarried, unemancipated minor from receiving abortion care until they either (1) notified a parent or guardian or (2)  obtained a judicial bypass. Planned Parenthood of Washoe County and an abortion provider filed a lawsuit challenging the parental notification law in the U.S. District Court of Nevada on June 28, 1985. After six years of litigation, in 1991, Judge Edward C. Reed held the law was unconstitutional and permanently enjoined it. 2023 WL 12064153. 

Thirty-one years later, the U.S. Supreme Court held there is no constitutional protection for abortion rights, thereby overruling Roe. Dobbs v. Jackson Women’s Health Organization. A year and a half later, on December 1, 2023, two county district attorneys moved for relief from judgment under Federal Rule of Civil Procedure 60(b)(5). The district attorneys – who the district attorneys of Carson City and Lyon County – argued that Dobbs removed the foundation by which the parental notification law was first enjoined and had substituted a rational-basis test that the law passed; they also argued that Dobbs abrogated cases recognizing third-party standing in the abortion context.

That same day, Judge Larry R. Hicks recused himself from the action, and the case was reassigned to Judge Anne R. Traum. Over the next two months, the court dealt with updating the parties to account for the deaths, organizational closures, and changes in office that had taken place since 1991. When the dust had settled, Planned Parenthood Mar Monte, Inc. (“PPMM”) was the plaintiff, represented by Planned Parenthood Federation of America and private counsel, and the defendants were the Nevada Attorney General and county district attorneys. 

On October 29, 2024, the court heard oral argument on defendants’ motion for relief from judgment. The next day, the court allowed the parties to file supplemental briefing to address alternative constitutional grounds for maintaining the injunction.

On November 21, the Carson City and Lyon County district attorneys filed a petition for mandamus in the U.S. Ninth Circuit Court of Appeals (24-7113). On December 21, the Ninth Circuit denied the motion, holding that the district attorneys “had not demonstrated a clear and indisputable right to the extraordinary remedy of mandamus.” 

On March 31, 2025, Judge Traum granted the motion for relief from judgment, vacating the permanent injunction and thereby allowing the parental notification law to go into effect beginning on April 30. 349 F.R.D. 213. First, Judge Traum found that the motion for relief was timely despite the approximately seventeen-month delay after Dobbs, because PPMM suffered no prejudice and the defendants faced practical challenges coordinating successor parties and accessing an archived record.

Then, Judge Traum held that the inequity prong of Rule 60(b)(5) — not the prior-judgment prong — governed the analysis, and that when an injunction's legal basis is overruled, modification is required without application of additional equitable factors. Applying post-Dobbs rational basis review, Judge Traum found that the law survived scrutiny, as the legislature could reasonably conclude the provisions served legitimate interests in encouraging parental involvement and protecting immature minors. Although PPMM raised alternative constitutional grounds — procedural due process, vagueness, and equal protection — the court declined to maintain the injunction on those bases because they had never been litigated on the merits, and no preliminary injunction motion had been filed.

PPMM appealed the order on April 11 (25-2432) and moved to stay the order on April 14. Judge Traum denied the motion to stay the order pending appeal but granted PPMM’s alternative motion for a temporary administrative stay on April 25. 2025 WL 1210968. This meant that the March 31st order vacating the injunction was stayed until the Ninth Circuit could resolve the motion for a stay pending appeal that PPMM filed on May 2. 

The administrative stay continued until July 18, 2025, when the Ninth Circuit denied PPMM’s motion for a stay pending appeal. The Ninth Circuit held that PPMM had failed to establish serious questions going to the merits of its argument that the Dobbs’ change in law did not warrant vacating the injunction under Federal Rule of Civil Procedure 60(b)(5). 

After the Ninth Circuit's order, events progressed rapidly. On July 21, PPMM filed a lawsuit challenging the parental notification law in Nevada state court. Planned Parenthood Mar Monte, Inc. v. Nevada. On July 22, Judge Traum ordered that the administrative stay be lifted. And, on July 23, PPMM moved to dismiss the federal case. 

On August 22, 2025, the Ninth Circuit granted PPMM’s motion to voluntarily dismiss its appeal. Judge Traum granted plaintiffs motion to dismiss on March 13, 2026, dismissing the case without prejudice. 2026 WL 710173. In her order, Judge Traum rejected the defendants’ arguments that there was no legal basis for a dismissal without prejudice and that they would be legally prejudiced by a dismissal.

The case is now closed.
