Five organizations, including the National Association of Diversity Officers in Higher Education (NADOHE) and the American Association of University Professors (AAUP), filed suit against President Donald J. Trump and numerous federal agencies on April 20, 2026, in the U.S. District Court for the District of Maryland. The plaintiffs challenged President Trump's March 26, 2026 Executive Order titled "Addressing DEI Discrimination by Federal Contractors," alleging it violates their First Amendment rights. According to the complaint, the Order broadly defines "racially discriminatory DEI activities" to include most mentions of "race or ethnicity" and requires federal contractors to agree they will not engage in such activities. The plaintiffs argued that the Order was designed to intimidate organizations and businesses into abandoning diversity, equity, and inclusion efforts by threatening loss of federal contracts, debarment, and potential civil or criminal penalties under the False Claims Act. The lawsuit sought declaratory and injunctive relief to prevent implementation of the Order.
