This is a case challenging the Department of Justice’s effort to stockpile millions of Americans' confidential voter data by demanding that nearly every state and the District of Columbia turn over their unredacted statewide voter registration lists. On April 21, 2026, Common Cause and Common Cause Education Fund, along with four individual Common Cause members, filed suit against the U.S. Department of Justice (DOJ) and Acting U.S. Attorney General Todd Blanche in the United States District Court for the District of Columbia. The plaintiffs sued the Department of Justice alleging violations of the Administrative Procedure Act (APA), separation of powers, and federalism principles. Represented by the American Civil Liberties Union (ACLU) of the District of Columbia, the Protect Democracy Project, and Citizens for Responsibility and Ethics in Washington, the plaintiffs sought a declaratory judgment that the DOJ’s actions are unlawful, injunctive relief to stop the DOJ from continuing its alleged practices, and deletion of all collected voter data. The plaintiffs claimed that the DOJ was using this data, which included Social Security numbers, dates of birth, addresses, and political party affiliations, to build a sprawling new voter surveillance and purging apparatus without statutory authorization. The plaintiffs alleged that this violated privacy laws by disclosing data to the Department of Homeland Security's (DHS) unreliable SAVE system and private contractors for mass citizenship checks. 

The plaintiffs filed a motion for partial summary judgment on May 19, 2026, and the government filed a motion to dismiss the case on June 2, 2026.  Briefing remains ongoing as of early June 2026.
