This case challenged the Trump Administration’s Environmental Protection Agency’s (EPA) decision to rescind its 2009 finding that greenhouse gas emissions (GHG) endanger public health.

On February 12, 2026, the EPA rescinded its 2009 “Endangerment Finding” that motor vehicle greenhouse gas (GHG) emissions endanger public health and are therefore subject to emission standards under the Clean Air Act (CAA). On March 19, 2026, the Commonwealth of Massachusetts, the State of California, and other states, municipalities, and jurisdictions filed a petition for review challenging the action of the EPA and its Administrator in the United States Court of Appeals for the District of Columbia Circuit. The case was assigned to Circuit Judges Justin R. Walker, J. Michelle Childs, and Bradley N. Garcia.

The petitioners argued that in rescinding the Endangerment Finding, the EPA violated the CAA and the Administrative Procedure Act (APA). They contended that the EPA lacks the statutory authority under Section 202(a)(1) of the CAA to rescind the Endangerment Finding—a determination previously upheld by the landmark Supreme Court in Massachusetts v. EPA (2007). They further asserted that the EPA violated the APA by failing to provide a reasoned justification for its reversal, ignoring substantial reliance interests, and inadequately responding to public comments. The petitioners disputed the EPA’s invocation of the major questions doctrine, which limits a federal agency’s ability to decide an issue of vast economic and political significance without clear congressional authorization, as Massachusetts found the EPA had the authority to regulate greenhouse gases, rendering the doctrine inapplicable. Petitioners sought to vacate the 2026 rule, reinstate the Endangerment Finding and associated standards, and remand the matter to the EPA for further proceedings.

On March 20, 2026, and April 13, 2026, the court consolidated this case with six other cases (26-1037, 26-1038, 26-1039, 26-1043, 26-1051, 26-1061). On March 20, 2026, the Truck and Engine Manufacturers Association, the National Federation of Independent Business, the American Free Enterprise Chamber of Commerce, the Illinois, Iowa, Kentucky, Missouri, North Dakota, and Tennessee Corn Growers Associations, and the American Petroleum Institute also moved to intervene as defendants. On April 13, 2026, the American Fuel & Petrochemical Manufacturers and Energy Marketers of America also filed a motion to intervene as defendants. The court granted these motions on April 22, 2026. 

On April 20, 2026, a coalition of medical and environmental groups, who are plaintiffs in the consolidated cases, moved to defer a call for briefing proposals pending EPA action on administrative petitions, or, in the alternative, to sever the issues filed by these plaintiffs. 

On May 20, 2026, the Parents of Minor Youth Petitioners lodged a motion to stay the underlying order pending the appeal. The same day, the from multiple consolidated cases filed a joint motion to complete the record, requesting the court add missing evidence to the case. 

On May 22, 2026, a coalition of defendants filed a motion to extend the time to file a motion.

On June 17, 2026, the court lodged the motion for stay pending appeal, formally submitteding it to the court clerk for processing and review. 

This case remains ongoing.
