On April 24, 2026, Arizona filed suit in the U.S. District Court for the District of Arizona against the U.S. Department of Homeland Security (DHS), U.S. Immigration and Customs Enforcement (ICE), and their respective agency heads in their official capacities. The complaint challenged DHS and ICE's January 23, 2026, purchase of a vacant 418,400 square foot industrial warehouse in Surprise, Arizona, for approximately $70 million, with plans to convert it into an immigration detention facility capable of holding between 500 and 1,500 detainees. The warehouse was not designed to house human beings, was located directly across the street from a hazardous chemical storage facility, and sat approximately one mile from two public schools serving roughly 2,000 students combined. Arizona alleged that Defendants violated the Administrative Procedure Act (APA) by failing to conduct required environmental review under the National Environmental Policy Act (NEPA), failing to ensure an "appropriate" place of detention as required by the Immigration and Nationality Act (INA), failing to consider existing detention facilities before committing to an industrial warehouse, and acting arbitrarily and capriciously in selecting the site without reasoned explanation. Arizona sought declaratory relief, vacatur of the agency's decision, and preliminary and permanent injunctive relief barring Defendants from operating or modifying the warehouse for detention purposes.
