This class action was filed on June 2, 2026, in the U.S. District Court for the Southern District of New York, by five transgender plaintiffs—three minors and two adults—on behalf of themselves and all similarly situated individuals who received medical treatment for gender dysphoria while under eighteen years of age at New York City healthcare institutions, including NYU Langone Hospitals and Mount Sinai Health System, between January 1, 2020, and May 5, 2026. The plaintiffs named as defendants the Acting Attorney General of the United States, the U.S. Department of Justice (DOJ), and several NYU entities.

The plaintiffs alleged that on May 7, 2026, NYU Langone Hospitals received a federal grand jury subpoena from the U.S. Attorney's Office for the Northern District of Texas—a district with no connection to the hospitals or patients involved—demanding seventeen broad categories of records identifying transgender patients who received gender-affirming care as minors, along with their clinical records and informed consent documents. The plaintiffs alleged that this subpoena was part of a broader federal administration campaign targeting transgender people and gender-affirming care, and that DOJ had shifted to using grand jury subpoenas after multiple federal district courts quashed or limited its prior civil administrative subpoenas seeking similar information. The plaintiffs asserted three causes of action: violation of the Fifth Amendment right to informational privacy, violation of the Fourth Amendment's prohibition on unreasonable searches and seizures, and breach of New York's physician-patient privilege under Civil Practice Law and Rules (CPLR) 4504(a). The plaintiffs sought declaratory and injunctive relief to prevent both DOJ from obtaining the requested information and NYU from producing it, as well as class certification, attorneys' fees, and costs.

DOJ Defendants, their officers, agents, successors, servants, employees, and attorneys, and any other persons who are in active concert or participation with them, are RESTRAINED and ENJOINED from: Seeking, receiving, using, retaining, or disseminating any identifying or sensitive health information of Plaintiffs and members of the Class through the Subpoenas at issue or substantially similar administrative or grand jury subpoenas as part of the U.S Department of Justices claimed investigations into health care offenses related to gender-affirming medical care.
