On May 27, 2026, the United States of America filed a complaint in the U.S. District Court for the District of Oregon, against the State of Oregon, Oregon Governor Tina Kotek, Oregon Transportation Commission Chair, and Oregon Department of Motor Vehicles (DMV) Administrator. The complaint alleged that Oregon's DMV had for many years issued confidential license plates and registrations to federal law enforcement vehicles operated by agencies including the Federal Bureau of Investigation (FBI), the Drug Enforcement Administration (DEA), the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF), Customs and Border Protection (CBP), and Immigration and Customs Enforcement (ICE). In April 2026, however, Oregon's DMV reversed course, pausing the issuance of confidential plates and registrations to all federal agencies while continuing to issue them to state and local law enforcement without restriction. The DMV also refused to issue even standard registrations to federal vehicles, instead directing federal agencies to use conspicuous U.S. Government plates, effectively compelling federal agents to publicly identify themselves. The United States asserted two counts under the Supremacy Clause: unlawful discrimination against the Federal Government and unlawful regulation of the Federal Government. The United States sought declaratory judgments, a permanent injunction, costs and fees, and any other relief the Court deemed just and proper.
