Case Summary

This case concerns a private Chinese biopharmaceutical contractor challenging the Department of Defense's (also called the "Department of War") designation of it as a “Chinese military company.”On June 11, 2026, WuXi AppTec Co., Ltd. (WXAT) filed this suit in the U.S. District Court for the District of Columbia against the U.S. Department of Defense and its administrators, including Secretary of War Pete Hegseth. WXAT, headquartered in China, challenged its designation as a Chinese military company (CMC) under Section 1260H of the National Defense Authorization Act (NDAA). Congress enacted Section 1260H in 2021, expanding the Secretary of Defense's directive to identify "Communist Chinese military companies" operating in the United States. The original statute covered only companies owned or controlled by the People's Liberation Army (PLA); Section 1260H broadened that scope to include companies with wider corporate ties, control relationships, and agency relationships with the PLA and other arms of the Chinese military. In 2024, the definition was further expanded to include "affiliated with" as a qualifying relationship. Companies classified as CMCs under the statute are barred from Department contracts, cannot pursue certain federal funds, and are subject to additional statutory restrictions on business conducted within the United States. Classification may also negatively impact the company's reputational and business interests in the U.S. and internationally.

WXAT is a global provider of research, manufacturing, and development services to pharmaceutical and biomedical companies. The company is traded on Chinese stock exchanges, but possesses a global customer base where the United States accounts for roughly 70% of the company’s 2025 revenue. A majority of the company’s board of directors and executives are U.S. citizens and the company has expanded its physical facilities into the U.S.

WXAT engaged the DoD multiple times in the two years before the June 10, 2026 designation. In response to the 2024 amendments to Section 1260H, WXAT briefed the DoD in August 2024 on the nature of its business, arguing that it did not meet the CMC classification. In January 2025, the next 1260H list published by the DoD did not include WXAT as a CMC. In August of that same year, following further amendments to Section 1260H,, WXAT requested and conducted another meeting with the DoD to reiterate its case against designation. Unknown to WXAT, and before that meeting took place, the Deputy Secretary of Defense sent a letter to the House and Senate Armed Services Committees on October 7 indicating that several companies, including WXAT, should be added to the 1260H list. On February 13, 2026, the DoD published a pre-publication version of that year's 1260H list, which included WXAT with the justification that WXAT is "indirectly owned by SASAC and is indirectly affiliated with SASTIND and the PLA." The list remained on the Federal Register for one hour before the DoD requested its removal. On May 9, 2026, WXAT submitted a Freedom of Information Act request seeking the DoD's reasoning behind the brief listing; the DoD replied only that it would not be required to respond within the statutory period. The list was republished on June 10, 2026, with WXAT on the list with the same justification. This litigation arises from WXAT’s designation on the June 10th list.

The complaint filed on June 11, 2026, by WXAT alleges that the decision by the Department to classify WXAT as a CMC was arbitrary and capricious in violation of the Administrative Procedure Act (APA) on both procedural and substantive grounds. WXAT claimed the DoD failed to provide substantive evidence supporting the designation and did not satisfy the APA's procedural requirements. WXAT also argued that the DoD's action exceeded its statutory authority and that placing WXAT on the 1260H list violated its Fifth Amendment liberty and property interests without due process. The complaint further alleged that WXAT had already suffered, and continued to suffer, significant financial and reputational harm. As a result, WXAT sought injunctions voiding its CMC designation, removing it from the Federal Register list, and preventing any enforcement or action against WXAT pursuant to the designation. This case was assigned to Chief Judge James E. Boasberg.

On June 29, 2026, WXAT filed a motion for preliminary injunction, amended the following day per order by the court, seeking to bar the DoD from “enforcing or giving effect” to the designation while the litigation proceeds. WXAT pointed to customers and suppliers who canceled contracts, terminated longstanding relationships, and moved their business to competitors in response to the designation. The DoD opposed the motion and requested that, if the court grants the preliminary relief to “stay any injunction pending any appeal.”

On Aug. 7, 2026, the Court granted WXAT’s motion enjoining the DoD from enforcing, implementing, or otherwise giving effect to the 1260H designation. The court also rejected the DoD’s request for a stay, finding no irreparable injury that the DoD would suffer from permitting the injunction to operate in the face of an appeal.

As of September 15, 2026, this case is ongoing.
