Case Summary

[This summary is temporary while we research the case]. WuXi AppTec Co., Ltd., a China-incorporated global Contract Research, Development, and Manufacturing Organization (CRDMO), filed this action on June 11, 2026, in the U.S. District Court for the District of Columbia. Plaintiff filed suit against the U.S. Department of Defense (also known as the "U.S. Department of War"), Secretary of War Pete Hegseth, Deputy Secretary, and Assistant Secretary, challenging its designation as a Chinese military company (CMC) under Section 1260H of the National Defense Authorization Act. Plaintiff asserted five causes of action under the Administrative Procedure Act (APA) and the Fifth Amendment, including arbitrary and capricious agency action, procedural violations, due process deprivations, ultra vires action, and unconstitutional vagueness, and sought declaratory relief, vacatur of the designation, mandatory and preliminary injunctive relief compelling its removal from the CMC list, and attorneys' fees.
