This case challenges the constitutionality of the removal protections of members of the National Labor Relations Board (NLRB).

On November 5, 2024, Amazon.com Services LLC filed suit against the NLRB in the District Court for the Central District of California under the Administrative Procedure Act and U.S. Constitution. This action arose when the NLRB allegedly attempted to force Amazon to bargain with The International Brotherhood of Teamsters. Amazon alleged that NLRB Members’ insulation from removal was unconstitutional because it encroached upon the executive authority granted to the President by Article II of the Constitution. Amazon sought injunctive relief to stop the NLRB proceedings that it claimed violated its fundamental due process rights because the Board’s basic structure is unconstitutional. It also sought declaratory relief that the removal protections of NLRB Members and NLRB Administrative Law Judges are unconstitutional. The case was assigned to District Judge Sherilyn P. Garnett.

On November 15, 2024, Amazon filed a motion for a preliminary injunction to stop the NLRB proceedings. On November 27, 2024, Teamsters Amazon National Negotiating Committee filed an application to intervene on behalf of the Defendants, which the court granted on December 2, 2024. The district court denied Amazon’s motion for preliminary injunction on February 5, 2025 because it concluded that it lacked jurisdiction to issue the requested relief under the Norris LaGuardia Actwhich strips federal courts of power to issue any injunction in a case involving or growing out of a labor dispute. On February 10, 2025, Amazon filed an interlocutory appeal of the district court decision to the U.S. Court of Appeals for the 9th Circuit, claiming that the constitutional challenge to the Board and its proceedings are too far removed from a labor dispute to trigger the Act’s jurisdictional limitations.

On June 16, 2025, Amazon filed its first motion in the 9th Circuit to stay the proceedings of the NLRB pending the appeal, claiming that it could face irreparable harm if they continued. The court denied the motion to stay on June 30, 2025. Oral arguments for the appeal occurred on August 14, 2025. On September 5, 2025, Amazon filed a second motion in the 9th Circuit to stay for the same reasons that was also denied three days later.

On December 29, 2025, the 9th Circuit affirmed the district court’s order denying Amazon’s motion for a preliminary injunction. It held that the underlying NLRB proceedings constitute a labor dispute which triggers the Norris LaGuardia Act’s jurisdictional limitations for federal courts.

On March 20, 2026, the district court issued an order staying the case pending the U.S. Supreme Court’s decision in Trump v. Slaughter.

The case is ongoing.
