Nine renewable energy trade associations filed suit on May 31, 2026, in the U.S. District Court for the District of Oregon against the DoD, the Secretary of Defense, the Assistant Secretary of Defense, and the DoD Military Aviation and Installation Assurance Siting Clearinghouse (the "Sitting Clearinghouse"), alleging that DoD unlawfully froze its statutorily mandated review process for utility-scale wind energy projects. Under federal law, wind turbines exceeding 200 feet above ground level require a Determination of No Hazard (DNH) from the Federal Aviation Administration (FAA), which cannot be issued until DoD completes its own review—a process formalized by the Ike Skelton National Defense Authorization Act for Fiscal Year 2011 and administered by the Sitting Clearinghouse. Plaintiffs alleged that DoD’s freeze occurred in stages: first stopping countersignature of pending mitigation agreements in August 2025, then halting issuance of draft mitigation agreements in December 2025, and finally imposing a complete halt to all mitigation agreement review activity on April 13, 2026. On May 7, 2026, DoD issued a formal “interim guidance” placing wind energy projects on indefinite hold while directing staff to continue reviewing all other types of energy projects. The freeze allegedly stalled at least 125 utility-scale wind energy projects across 25 states, placing them at risk of default under financing and power purchase agreements, loss of federal tax credit eligibility, and other significant harms. DoD communicated with developers only through boilerplate form letters citing vague “evolving risks” without project-specific explanation. Plaintiffs, represented by private counsel, asserted two APA counts: that the freeze was arbitrary, capricious, and contrary to law under Section 706(2), and that it constituted an unlawful withholding or unreasonable delay of required agency action under Section 706(1). The plaintiffs sought declaratory relief, vacatur of DoD's freeze policy, specific affirmative orders compelling DoD to resume its review obligations within defined timeframes, and attorneys' fees. The case was assigned to Magistrate Judge Youlee Yim You for discovery proceedings and was later reassigned to District Judge Karin J. Immergut.

On June 11, 2026, the plaintiffs moved for a nationwide stay or a preliminary injunction enjoining the DoD’s freeze, requiring the DoD to resume processing wind project reviews, and directing the DoD to provide status reports every thirty days on its progress. The plaintiffs argued that they were likely to succeed on the merits, asserting that DoD’s freeze violated the APA for four reasons: DoD (1) did not give a reasoned explanation for the policy change, (2) did not consider the factors that Congress directed it weight; (3) did not account for the reliance that the long-standing review process had created, and (4) based its decision on a goal of stopping wind energy development while prioritizing oil and gas instead. The plaintiffs also argued irreparable harm absent relief, citing canceled projects and breached contracts, expiring financing commitments, and lost development opportunities. Finally the plaintiffs contended that a stay or preliminary injunction would serve the public interest because the public would be harmed by the loss of energy generation, increased energy costs, and job and economic opportunities associated with wind energy development.

The plaintiffs filed an amended complaint on June 22, 2026. The complaint added twenty-one new “developer” plaintiffs, and categorized the remaining plaintiffs as “associational” plaintiffs. It also added three defendants, including the Department of the Air Force, the Department of the Army, and the Department of the Navy. The amended complaint expanded discussions of the impacts of the freeze on the wind energy industry to address Power Purchase Agreements (PPAs), equipment procurement, labor contracts, and interconnection issues. The amended complaint alleged new facts regarding the DoD’s discriminatory treatment of wind projects compared to oil and gas projects and alleged that the defendants bypassed a mandatory notice-and-comment period, arguing that the policy change implementing the freeze constitutes a legislative rule requiring public input.

On July 6, 2026, the defendants moved to dismiss the case for lack of jurisdiction and filed their response to the plaintiffs’ motion for a stay or preliminary injunction. The defendants argued that the plaintiffs’ claims should have been brought before a Court of Appeals because the Federal Aviation Act provides that challenges to FAA actions are reviewable only in a court of appeals in the first instance. The defendants further contended that the plaintiffs lacked standing and had failed to identify a final agency action under the APA subject to judicial review. As to the motion for a stay or preliminary injunction, the defendants argued that the plaintiffs were seeking judicial oversight of the entire Sitting Clearinghouse program rather than seeking to preserve the status quo, and that the motion should therefore be denied.

On July 16, 2026, eighteen states and the District of Columbia moved to intervene as plaintiffs. They argued that the DoD’s freeze affected their rights in multiple ways, including undermining efforts to produce clean and renewable energy, maintain grid stability, and enforce their own clean energy policies. They, like the original plaintiffs, asked the court to vacate and enjoin the freeze.
