On June 18, 2026, As You Sow, a nonprofit organization, filed this lawsuit in the U.S. District Court for the District of Columbia against DOL under the FOIA, 5 U.S.C. § 552. The plaintiff alleged that DOL unlawfully withheld records responsive to its April 16, 2024 FOIA request seeking spreadsheets containing all consolidated (Type 2) EEO-1 reports for federal contractors for 2021 and 2022. According to the complaint, the reports contained workforce demographic information—including employees' race, ethnicity, sex, and job categories—and enabled analysis of federal contractors' workforce diversity. DOL acknowledged the request, assigned it to the Office of Federal Contract Compliance Programs (OFCCP), and invoked a ten-day extension based on its complexity. After more than two years without receiving the requested records, As You Sow filed administrative appeals challenging both DOL's failure to respond and its denial of a fee waiver. DOL ultimately granted the fee waiver and remanded the request to OFCCP, but the agency still had not produced any records or indicated when it would do so. The plaintiff alleged that DOL had improperly withheld agency records in violation of FOIA and sought declaratory and injunctive relief requiring production of the requested records, as well as costs and attorneys' fees.

The court assigned the case to District Judge James E. Boasberg. As of July 2026, the case remains at the complaint stage.
