This is a case challenging an interim final rule (IFR) issued by the United States Department of Health and Human Services (HHS) and the Center for Medicare and Medicaid Services (CMS). The IFR, an implementation of Section 71119 of the One Big Beautiful Bill Act (H.R. 1), narrowed the categorical exclusions from the work requirement for certain Medicaid recipients, making it more difficult for recipients to avoid the work requirement due to medical reasons. On June 29, 2026, twenty-five states and the District of Columbia filed this lawsuit in the United States District Court for the District of Massachusetts. They sued the defendants, CMS Administrator Dr. Mehmet Oz and HHS Secretary Robert F. Kennedy, Jr., under the Administrative Procedure Act (APA). The plaintiffs sought a stay of the effective date of the challenged provisions of the IFR, a declaratory judgment, a preliminary and permanent injunction, and vacatur of the challenged provisions.

The plaintiffs argued that the IFR violates the APA because it is contrary to law, arguing that the IFR violates H.R. 1. The IFR limits qualification under the “medically frail” or “special medical needs” exceptions to the work requirement to those whose condition significantly impairs the individual’s ability to comply with the requirement, a requirement that the complaint argued does not exist in H.R. 1. The IFR makes similar limitations to the exception of emergencies preventing individuals from meeting the work requirement, which the plaintiffs also argued was narrower than H.R. 1 provides. The IFR also limits states’ ability to allow individuals to ‘self-attest’ that they are specifically excluded from the work requirement, which the plaintiffs argued violates the provision in H.R. 1 that expressly permits states to “elect to not require an individual to verify information” that they are a “specified excluded individual.” The plaintiffs also argued that the IFR violates the APA because it is arbitrary and capricious for failing to explain its reasons for changing existing policy. Finally, the plaintiffs argued that the IFR violates the Spending Clause of the United States Constitution because it does not provide the plaintiff states with clear notice of their obligations to satisfy its conditions to receive Medicaid funding and places retroactive conditions that the plaintiff states could not have reasonably foreseen when they began implementing H.R. 1.

The case was assigned to District Judge Richard G. Stearns.

Alongside their complaint, the plaintiffs moved for a preliminary injunction on June 29, 2026. On July 29, 2026, the Court denied the motion without prejudice, holding that the plaintiffs did not face irreparable harm from complying with the IFR during the course of litigation, as the federal government had previously represented to the states that it would reimburse 90% of the states’ expenses in designing, developing, and installing state eligibility systems to implement the rule. The Court indicated that it intended to reach the merits of the narrowed work requirement exceptions by January 1, 2027. 

The case is ongoing.
