On July 2, 2026, affiliates of the American Federation of Government Employees and the National Federation of Federal Employees filed this lawsuit in the U.S. District Court for the District of Maryland against the Department of Defense and the Secretary of Defense. The plaintiffs challenged the Secretary's April 9, 2026 memorandum directing DoD agencies to terminate all collective bargaining agreements within 24 hours, alleging that the Department had reversed a practice of honoring those agreements in response to President Trump's Executive Order 14251. The plaintiffs alleged that DoD did so without a reasonable explanation, without considering reliance interests or less disruptive alternatives, and without identifying the local employing offices of police officers, security guards, and firefighters that the Executive Order left covered by the Federal Service Labor-Management Relations Statute.
